(3) When any position to be filled involves fiduciary responsibility, the
5appointing authority
, where shall conduct a criminal history background check
6before offering employment to an applicant for the position. If otherwise permitted
7by law,
the appointing authority may require the appointee to furnish bond or other
8security, and shall notify the administrator of the amount and other details thereof.
9Any surety company authorized to do business in this state shall be a sufficient
10security on any such bond.
