SENATE AMENDMENT 1,
TO ASSEMBLY BILL 3

Schachtner, Larson, Hansen, Bewley, Shilling, Miller, Ringhand, Risser,
Erpenbach and Carpenter.
At the locations indicated, amend the engrossed bill
49.82 (3) of the statutes is created to read:
49.82 (3) Public assistance advisory committee.
(a) The department of health 5
services, in consultation with the department of children and families and the 6
department of administration, shall create an advisory committee to review 7
proposed legislation and proposed requests for approval from the federal 8
government of changes to public assistance programs and to review performance 9
data, outcomes, and costs of changes to public assistance programs after federal 10
approval of changes to those programs.
(b) The department of health services shall appoint to the advisory committee 12
under par. (a) participants in public assistance programs; representatives of 13
advocacy groups, including groups that support the rights of individuals with
physical and invisible disabilities; providers of services under public assistance 2
programs; representatives of the state agencies that administer public assistance 3
programs; members of the legislature, suggested by the majority and minority 4
leaders of both houses of the legislature; and policy experts from organizations such 5
as the University of Wisconsin's Population Health Institute and Institute for 6
Research on Policy.
(c) A state agency that administers a public assistance program that is the 8
subject of a proposed waiver request to be submitted to the federal government shall, 9
in collaboration with the advisory committee under par. (a), do all of the following:
1. Hold a public comment period lasting at least 30 days before the development 11
of the waiver proposal language.
2. Conduct no less than 3 public hearings on the proposed waiver before the 13
waiver is submitted to the federal government.
(d) No state agency may submit a request to waive federal law involving a 15
public assistance program without approval of the proposed waiver request by the 16
joint committee on finance.”.
This act takes effect on the day after 19
publication, except as follows:
The treatment of sections 49.145 (3) (a) and (c), 49.155 (1m) (cr) and (2m), 21
49.79 (1p), and 49.823 of the statutes takes effect on January 1, 2019.”.
