Notice regarding the effective date of repeal re: hemp pilot program
2019 Wisconsin Act 68, section 84 (1), requires the Department of Agriculture, Trade and Consumer Protection to notify the Legislative Reference Bureau when the secretary of the U.S. Department of Agriculture establishes a plan under section 297C of the Agricultural Marketing Act of 1946. 2019 Wisconsin Act 68, section 87 (1), provides that the repeal of Wis. Stat. § 94.55 (3)1 takes effect one year after the date on which the secretary of the U.S. Department of Agriculture establishes the aforementioned plan, and requires the Legislative Reference Bureau to publish a notice in the Wisconsin Administrative Register that specifies the date on which the aforementioned provision is repealed. In a letter dated January 14, 2020, the Department of Agriculture, Trade and Consumer Protection notified the Legislative Reference Bureau that a plan under section 297C of the Agricultural Marketing Act of 1946 was established and that, specifically, the U.S. Department of Agriculture established an interim final rule, 7 CFR Part 990, in 84 FR 58554, effective October 31, 2019. 1 Section 94.55 (3), Wis. stats., was created by 2017 Wisconsin Act 100 and requires the Department of Agriculture, Trade and Consumer Protection to create a pilot program to study the growth, cultivation, and marketing of industrial hemp.
