ASSEMBLY AMENDMENT 1, TO 1997 ASSEMBLY BILL 313

AB313-AA1,1,1 At the locations indicated, amend the bill as follows:

AB313-AA1,1,3 1. Page 2, line 2: delete "The" and substitute "(1) Subject to subs. (2) and (3), the".

AB313-AA1,1,4 2. Page 2, line 15: after that line insert:

AB313-AA1,1,6 "(2) The special list described under sub. (1) may not include any of the following:

AB313-AA1,1,8 (a) Any person who suffers from alcoholism, as defined in s. 51.01 (1m), and who is not a qualified person with a disability, as defined in 42 USC 12111 (8).

AB313-AA1,1,11 (b) Any person who is currently engaging in the use of a controlled substance, as defined in s. 961.01 (4), and who is not a qualified person with a disability, as defined in 42 USC 12111 (8) and 42 USC 12114 (a) and (b).

AB313-AA1,2,3 (c) Any person who suffers from a learning disability and who is not a qualified person with a disability, as defined in 42 USC 12111 (8), if that learning disability is from a cause other than a developmental disability, as defined in s. 51.01 (5) (a).

AB313-AA1,2,8 (3) If any provision or clause of this section or application thereof to any person or circumstances is held invalid, such invalidity shall affect other provisions or applications of the section which can be given effect without the invalid provision or application, and to this end the provisions of this section are declared to be unseverable.
