ASSEMBLY AMENDMENT 1, TO 2003 ASSEMBLY BILL 493

AB493-AA1,1,1 At the locations indicated, amend the bill as follows:

AB493-AA1,1,2 1. Page 2, line 1: delete lines 1 and 2 and substitute:

AB493-AA1,1,3 " Section 1. 59.69 (2) (bm) of the statutes is amended to read:".

AB493-AA1,1,4 2. Page 2, line 3: delete "(intro.)".

AB493-AA1,1,9 3. Page 2, line 11: delete that line and substitute "not condition or withhold approval of a conditional use permit under this section based upon the property owner entering into a contract, or discontinuing, modifying, extending, or renewing any existing contract, with a 3rd party under which the 3rd party is engaging in a lawful use of the property.".

AB493-AA1,1,10 4. Page 2, line 12: delete lines 12 to 20.

AB493-AA1,1,11 5. Page 2, line 21: before that line insert:

AB493-AA1,1,12 " Section 3m. 60.61 (4) (e) of the statutes is created to read:

AB493-AA1,2,5 60.61 (4) (e) Neither the town board nor the town zoning committee may condition or withhold approval of a conditional use permit under this section based upon the property owner entering into a contract, or discontinuing, modifying, extending, or renewing any contract, with a 3rd party under which the 3rd party is engaging in a lawful use of the property.".
