SENATE AMENDMENT 2, TO 2003 SENATE BILL 250

SB250-SA2,1,1 At the locations indicated, amend the bill as follows:

SB250-SA2,1,4 1. Page 1, line 4: delete "and operation of a Hmong cultural center" and substitute "of a facility for an organization known as the Multicultural Center of Green Bay".

SB250-SA2,1,5 2. Page 2, line 1: delete lines 1 to 24 and substitute:

SB250-SA2,1,6 " Section 1m. 13.48 (38) of the statutes is created to read:

SB250-SA2,2,2 13.48 (38) Multicultural Center of Greater Green Bay. (a) The legislature finds and determines that the population of Wisconsin consists of a number of peoples of diverse cultures. The legislature finds that supporting cultural diversity throughout Wisconsin is a statewide responsibility of statewide dimension. To better ensure the cultural diversity of this state, the legislature finds that it will have a direct and immediate effect on a matter of statewide concern for the state to construct a facility for an organization known as the Multicultural Center of Greater Green Bay.

SB250-SA2,2,9 (b) Notwithstanding s. 18.04 (1) and (2), the building commission shall authorize $500,000 in general fund supported borrowing to make a grant to an organization known as the Multicultural Center of Greater Green Bay for construction of a facility in Green Bay. As a condition precedent to receipt of the grant, the organization shall enter into an agreement with the secretary of administration guaranteeing that the facility will be operated to serve the nonsectarian cultural interests.

SB250-SA2,2,13 (c) If, for any reason, the grant under par. (b) is not used to construct the facility in Green Bay, or the center is not operated to serve nonsectarian cultural interests, the state shall retain an ownership interest in the facility equal to the amount of the state's grant.".

SB250-SA2,2,16 4. Page 3, line 14: delete the material beginning with that line and ending with page 4, line 2, and substitute:

SB250-SA2,2,17 " Section 3m. 20.866 (2) (zbt) of the statutes is created to read:

SB250-SA2,2,22 20.866 (2) (zbt) Multicultural Center of Greater Green Bay. From the capital improvement fund, a sum sufficient for the building commission to provide a grant to the organization specified in s. 13.48 (38) (b) for construction of a facility in the city of Green Bay. The state may contract public debt in an amount not to exceed $3,000,000 for this purpose.

SB250-SA2, s. 4m Section 4m. 20.867 (3) (bo) of the statutes is created to read:

SB250-SA2,3,6 20.867 (3) (bo) Principal repayment, interest and rebates; Multicultural Center of Greater Green Bay. A sum sufficient to reimburse s. 20.866 (1) (u) for the payment of principal and interest costs incurred in financing the construction of a facility for an organization known as the Multicultural Center for Greater Green Bay, and to make the payments determined by the building commission under s. 13.488 (1) (m) that are attributable to the proceeds of obligations incurred in financing the facility.".

SB250-SA2,3,28 "(2x) Notwithstanding section 13.48 (38) (b) of the statutes, as created by this act, the building commission shall not make a grant to an organization known as the Multicultural Center of Greater Green Bay for construction of a facility, as enumerated in 2003 Wisconsin Act 33, section 9106 (1) (am), under section 13.48 (38) of the statutes, as created by this act, unless the department of administration has reviewed and approved plans for the project. Notwithstanding sections 16.85 (1) and 16.855 (1) of the statutes, the department of administration shall not supervise any services or work or let any contract for the project. Section 16.87 of the statutes does not apply to the project.".
