4"d. A notarized statement by a person legally authorized to act on behalf of the
5private school that a criminal background check of each person who will be employed
6as instructional staff by the private school when the school begins to participate in
7the program under this section was conducted within the immediately preceding 5
8years or will be conducted before the school begins to participate, and will be
9conducted at least once every 5 years thereafter, using the procedure specified in par.
10(g).".

(7) (g) Each private school participating in the program under this
8section shall conduct a criminal background check through the department of justice
9on each person employed by the private school as instructional staff when the person
10is initially employed and at least once every 5 years thereafter. If the person is a
11nonresident, the private school shall require the person to be fingerprinted on 2
12fingerprint cards, each bearing a complete set of the person's fingerprints, and shall
13submit the cards to the department of justice. The department of justice may provide
14for the submission of the fingerprint cards to the federal bureau of investigation for
15the purposes of verifying the identity of the person fingerprinted and obtaining
16records of his or her criminal arrests and convictions.".

18"(2m) Within 120 days after the effective date of this subsection, a private
19school participating in the program under section 119.23 of the statutes shall conduct
20a criminal background check through the department of justice on each person
21employed as instructional staff by the private school using the procedure specified
22in section 119.23 (7) (g) of the statutes, as created by this act.".
