The Honorable, The Legislature:
Pursuant to s. 227.19 (4) (b) 4., Stats., the Department hereby recalls final proposed rules DHS 137, and submits modified final proposed rules DHS 137 for legislative review.
The Department submitted the original final proposed rules to the Chief Clerks on June 2, 2010. The rules were subsequently assigned to the Senate Committee on Health, Health Insurance, Privacy, Property Tax Relief, and Revenue and the Assembly Committee on Health and Healthcare Reform. The review period of each Committee is expired.
Subsequent to the expiration of the Committee review periods, the Department determined that an error in ss. DHS 137.03 (4) and 137.04 (1) (a) and (b) in language use has caused and may continue to cause confusion among the general public when making donations. The Department has corrected the error in rule language by removing the language. The modified rule is attached.
Please re-refer CR 10-137 Clearinghouse Rules Jackets, already in your possession, and the attached modified final proposed rules to the appropriate standing Committees to begin the new rule review period required under s. 227.19 (4) (b) 4., Stats.
