AB43, s. 9 19Section 9. 125.51 (4) (c), (d) and (f) to (u) of the statutes are created to read:
AB43,4,2320 125.51 (4) (c) If territory containing premises covered by a license is annexed
21to the municipality and if the municipality's quota would not otherwise allow licenses
22for the premises, the quota shall be increased to include a license for each premises
23in the annexed territory.
AB43,5,224 (d) Detachment of territory shall decrease the quota of the remainder of the
25municipality by the number of premises covered by licenses existing in the detached

1territory, except that detachment shall not decrease the quota of the remainder to
2less than one license per 500 persons or less than one license.
AB43,5,63 (f) Notwithstanding the quota of a town, licenses issued by the town under s.
4176.05 (21) (k), 1979 stats., remain valid and may be renewed by the town board, but
5the town board may not issue any new "Class B" licenses until the total number of
6licenses is less than the quota.
AB43,5,117 (g) Notwithstanding the quota of a municipality, its governing body may, by a
8three-fourths vote of its members, issue a license limited to the sale of wine for
9consumption only on the premises to any person engaged in preserving a place of
10historic significance built during the state's first 5 years of statehood and operating
11the place as a restaurant.
AB43,5,1612 (h) Notwithstanding the quota of a municipality, its governing body may, by a
13three-fourths vote of its members, issue a license to any restaurant existing on
14August 7, 1977, with a museum having permanent exhibition space open to the
15public at least 3 times the area of the restaurant, whether or not the museum existed
16on August 7, 1977.
AB43,5,1817 (i) Notwithstanding the quota of the municipality, licenses issued under s.
18176.05 (21) (h), 1979 stats., remain valid and may be renewed by the municipality.
AB43,5,2419 (j) Each municipality that issues "Class B" licenses shall issue a "Class B"
20license to any club which, on June 30, 1982, held a "Class B" license issued by the
21department under s. 176.05 (4a), 1979 stats. Licenses issued under this paragraph
22shall be renewed annually, upon application, unless revoked under s. 125.12. The
23quota of a municipality is permanently increased by the number of licenses it issues
24under this paragraph.
AB43,6,2
1(k) Notwithstanding the quota of a town, the town board may issue a license
2to any of the following:
AB43,6,43 1. An outdoor theater operated by a professional repertory theater company
4whose productions consist mostly of classical drama.
AB43,6,65 2. A conference center and restaurant used by the staff and patrons of a
6professional repertory theater company for lodging and meetings.
AB43,6,87 (L) Notwithstanding the quota of a town, the town board may issue a license to
8a person operating a ski chalet on property owned by the state.
AB43,6,139 (m) Notwithstanding the quota of a municipality, its governing body may, by
10a three-fourths vote of its members, issue a license to any restaurant with a museum
11having permanent exhibition space open to the public at least 3 times the area of the
12restaurant if the building housing the museum was built during the first 8 years of
13statehood or earlier.
AB43,6,1514 (n) Notwithstanding its quota, a village may issue a license for a hotel owned
15by an American Indian tribe.
AB43,6,1816 (o) Notwithstanding its quota, a village may issue a license for a motel located
17on a lake, which is the headwaters of a river, which is part of the border between this
18state and Minnesota.
AB43,6,2219 (p) Notwithstanding its quota, a town which borders on a lake, is adjacent to
20a 2nd class city and is located in a county with a population of 300,000 or more may
21issue a license for a tavern which is covered by a Class "B" license on December 8,
221987, if the tavern is not located within 500 feet of a lake.
AB43,6,2423 (q) Notwithstanding the quota of a municipality, its governing body may issue
24a license to persons conducting business at a racetrack, as defined in s. 562.01 (12).
AB43,7,3
1(r) Notwithstanding its quota, a village may issue a license to a post of a
2veteran's organization for a building that was rebuilt after being destroyed by a
3tornado.
AB43,7,64 (s) Notwithstanding the quota of a municipality, its governing body may issue
5a license to a restaurant and public golf course situated on at least 200 acres of land,
6if the restaurant and public golf course are located adjacent to STH 57.
AB43,7,107 (sm) Notwithstanding the quota of a town, the town board may issue a license
8to a person who owns a building located at the intersection of STH 11 and STH 80
9in Grant County, if the person had a license under sub. (3) issued to him or her
10previously.
AB43,7,1311 (t) 1. Notwithstanding the quota of a municipality, its governing body may issue
12a license to a restaurant that was established in 1949 and is located on STH 42 across
13from a town park.
AB43,7,1514 2. No license may be issued under subd. 1. after July 29, 1995, but a license
15issued under subd. 1. before July 29, 1995, may be renewed.
AB43,7,1916 (u) 1. Notwithstanding the quota of a municipality, its governing body may
17issue a license to a corporation that holds a Class "B" license, a "Class C" license and
18a "Class A" license since January 1, 1992, if the licenses are issued by that governing
19body.
AB43,7,2320 2. No license may be issued under subd. 1. after September 1, 1995, or 30 days
21after July 29, 1995, whichever is later, but a license issued under subd. 1. on or before
22September 1, 1995, or on or before 30 days after July 29, 1995, whichever is later, may
23be renewed.
