The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB890, s. 1 1Section 1. 146.89 (1) of the statutes is renumbered 146.89 (1) (intro.) and
2amended to read:
AB890,2,33 146.89 (1) (intro.) In this section, "volunteer:
AB890,2,10 4(r) "Volunteer health care provider" means an individual who is licensed as a
5physician under ch. 448, dentist under ch. 447, registered nurse, practical nurse, or
6nurse-midwife under ch. 441, optometrist under ch. 449, or physician assistant
7under ch. 448 or certified as a dietitian under subch. V of ch. 448 and who receives
8no income from the practice of that health care profession or who receives no income
9from the practice of that health care profession when providing services at the
10nonprofit agency or school specified under sub. (3).
AB890, s. 2 11Section 2. 146.89 (1) (g) of the statutes is created to read:
AB890,2,1212 146.89 (1) (g) "School" means a public elementary or secondary school.
AB890, s. 3 13Section 3. 146.89 (1) (h) of the statutes is created to read:

2section only if he or she submits a joint application with a nonprofit agency or school

to the department of administration and that department approves the
4application. The department of administration shall provide application forms for
5use under this paragraph.
AB890, s. 5 6Section 5. 146.89 (2) (c) of the statutes is amended to read:
AB890,3,97 146.89 (2) (c) The department of administration shall notify the volunteer
8health care provider and the nonprofit agency or school board of the department's
9decision to approve or disapprove the application.
AB890, s. 6 10Section 6. 146.89 (2) (d) of the statutes is amended to read:
AB890,3,1811 146.89 (2) (d) Approval of an application of a volunteer health care provider is
12valid for one year. If a volunteer health care provider wishes to renew approval, he
13or she shall submit a joint renewal application with a nonprofit agency or school
14board
to the department of administration. The department of administration shall
15provide renewal application forms that are developed by the department of health
16and family services and that include questions about the activities that the
17individual has undertaken as a volunteer health care provider in the previous 12
18months.

AB890,4,76 146.89 (3m) All of the following apply to a volunteer health care provider whose
7joint application with a school board is approved under sub. (2):
AB890,4,128 (a) Before providing health care services in a school, the volunteer health care
9provider shall provide to the school board proof of satisfactory completion of a course
10or courses in basic first aid and basic cardiopulmonary resuscitation taught by an
11individual, organization, or institution of higher education approved by the
12department.
AB890,4,1413 (b) Under this section, the volunteer health care provider may provide the
14following health care services:
AB890,4,1515 1. The health care services specified in sub. (3) (b) 1. to 5. and 7.
AB890,4,1616 2. First aid for illness or injury.
AB890,4,1717 3. The administration of drugs, as specified in s. 118.29 (2) (a) 1.
AB890,4,1818 4. Health screenings.
AB890,4,2019 5. Any other health care services designated by the department of public
20instruction by rule.
AB890,4,2321 (c) Under this section, the volunteer health care provider may not provide
22emergency medical services, hospitalization, or surgery, except as provided in par.
23(b) 2. and 5.
AB890,4,2524 (d) Any health care services provided under par. (b) shall be provided without
25charge at the school and shall be available to all students regardless of income.

1Section 11. Initial applicability.
AB890,5,42 (1) Volunteer health care provider program. This act first applies to
3applications submitted under section 146.89 (2) (a) of the statutes, as affected by this
4act, on the effective date of this subsection.
