moneys specified for deposit

shall be credited to this appropriation.
SB447, s. 4 4Section 4. 71.10 (5f) of the statutes is created to read:
SB447,3,65 71.10 (5f) Breast cancer research program. (a) Definitions. In this
6subsection:
SB447,3,97 1. "Breast cancer research program" means the program under s. 255.055 that
8provides grants for breast cancer research and the payment of administrative
9expenses related to the administration of this subsection.
SB447,3,1010 2. "Department" means the department of revenue.
SB447,3,1411 (b) Voluntary payments. 1. `Designation on return.' Every individual filing an
12income tax return who has a tax liability or is entitled to a tax refund may designate
13on the return any amount of additional payment or any amount of a refund due that
14individual for the breast cancer research program.
SB447,3,1715 2. `Designation added to tax owed.' If the individual owes any tax, the
16individual shall remit in full the tax due and the amount designated on the return
17for the breast cancer research program when the individual files a tax return.
SB447,3,2118 3. `Designation deducted from refund.' Except as provided in par. (d), if the
19individual is owed a refund for that year after crediting under ss. 71.75 (9) and 71.80
20(3), the department of revenue shall deduct the amount designated on the return for
21the breast cancer research program from the amount of the refund.
SB447,3,2522 (c) Errors; failure to remit correct amount. If an individual who owes taxes fails
23to remit an amount equal to or in excess of the total of the actual tax due, after error
24corrections, and the amount designated on the return for the breast cancer research
25program:

11. The department shall reduce the designation for the breast cancer research
2program to reflect the amount remitted in excess of the actual tax due, after error
3corrections, if the individual remitted an amount in excess of the actual tax due, after
4error corrections, but less than the total of the actual tax due, after error corrections,
5and the amount originally designated on the return for the breast cancer research
6program.
SB447,4,97 2. The designation for the breast cancer research program is void if the
8individual remitted an amount equal to or less than the actual tax due, after error
9corrections.
SB447,4,1610 (d) Errors; insufficient refund. If an individual who is owed a refund which does
11not equal or exceed the amount designated on the return for the breast cancer
12research program, after crediting under ss. 71.75 (9) and 71.80 (3) and after error
13corrections, the department shall reduce the designation for the breast cancer
14research program to reflect the actual amount of the refund that the individual is
15otherwise owed, after crediting under ss. 71.75 (9) and 71.80 (3) and after error
16corrections.
SB447,4,1817 (e) Conditions. If an individual places any conditions on a designation for the
18breast cancer research program, the designation is void.
SB447,4,2119 (f) Void designation. If a designation for the breast cancer research program
20is void, the department shall disregard the designation and determine amounts due,
21owed, refunded, and received without regard to the void designation.
SB447,4,2322 (g) Tax return. The secretary of revenue shall provide a place for the
23designations under this subsection on the individual income tax return.
SB447,5,3
1(h) Certification of amounts. Annually, on or before September 15, the
2secretary of revenue shall certify to the department of health and family services, the
3department of administration, and the state treasurer:
SB447,5,64 1. The total amount of the administrative costs, including data processing
5costs, incurred by the department in administering this subsection during the
6previous fiscal year.
SB447,5,87 2. The total amount received from all designations for the breast cancer
8research program made by taxpayers during the previous fiscal year.
SB447,5,119 3. The net amount remaining after the administrative costs, including data
10processing costs, under subd. 1. are subtracted from the total received under subd.
112.
SB447,5,1712 4. From the moneys received from designations for the breast cancer research
13program, an amount equal to the sum of administrative expenses, including data
14processing costs, certified under subd. 1. shall be deposited in the general fund and
15credited to the appropriation account under s. 20.566 (1) (hp), and the net amount
16remaining that is certified under subd. 3. shall be credited to the appropriation under
17s. 20.435 (5) (hc).
SB447,5,2418 5. Amounts designated for the breast cancer research program under this
19subsection are not subject to refund to the taxpayer unless the taxpayer submits
20information to the satisfaction of the department, within 18 months after the date
21on which the taxes are due or the date on which the return is filed, whichever is later,
22that the amount designated is clearly in error. Any refund granted by the
23department under this subdivision shall be deducted from the moneys received
24under this subsection in the fiscal year for which the refund is certified.
SB447, s. 5 25Section 5. 255.055 of the statutes is created to read:

1255.055 Breast cancer research grant program. (1) Subject to sub. (2),
2from the appropriation under s. 20.435 (5) (hc), the department shall award grants
3to eligible persons that are located in Wisconsin, including physicians, hospitals, as
4defined in s. 50.33 (2), clinical laboratories, and institutions of higher education, as
5defined in s. 108.02 (18), to conduct breast cancer research projects. Breast cancer
6research projects shall include projects to develop and advance the understanding
7of the techniques and modalities that are effective in the early detection, prevention,
8cure, screening, and treatment of breast cancer and may include projects that involve
9clinical trials.
SB447,6,16 10(2) The department shall appoint a breast cancer research advisory committee
11under s. 15.04 (1) (c) and shall consult with the advisory committee before awarding
12any grant under sub. (1). The advisory committee shall include a breast cancer
13patient advocate and representatives of the Wisconsin Chapter of the American
14Cancer Society. Members of the advisory committee may not receive compensation
15for serving on the committee but shall be reimbursed for expenses actually and
16necessarily incurred in the performance of their duties.
SB447,6,19 17(3) After consulting with the breast cancer advisory committee under sub. (2),
18the department shall promulgate rules specifying the eligibility criteria and
19procedures for awarding grants under sub. (1).
SB447, s. 6 20Section 6. Initial applicability.
SB447,6,2521 (1) The treatment of section 71.10 (5f) of the statutes first applies to taxable
22years beginning on January 1 of the year in which this subsection takes effect, except
23that if this subsection takes effect after July 31 section 71.10 (5f) of the statutes first
24applies to taxable years beginning on January 1 of the year following the year in
25which this subsection takes effect.

1Section 7. Effective dates. This act takes effect on the day after publication,
2except as follows:
SB447,7,73 (1) The treatment of section 255.055 of the statutes takes effect on the first day
4of the 3rd month beginning after the date on which the secretary of revenue first
5credits the appropriation account under section 20.435 (5) (hc) of the statutes, as
6created by this act, as specified under section 71.10 (5f) (h) 5. of the statutes, as
7created by this act.
