AB191,30 9Section 30. 346.807 of the statutes is created to read:
AB191,11,12 10346.807 Operating personal delivery device on sidewalk. (1) Except as
11provided in s. 346.94 (18m) (a) 2. and 349.236 (1) (b), a personal delivery device may
12be operated upon any sidewalk or crosswalk.
AB191,11,15 13(2) Every personal delivery device operator shall ensure that the operation of
14the personal delivery device upon a sidewalk or crosswalk satisfies all of the
15following:
AB191,11,1716 (a) The personal delivery device operator shall control or monitor the
17navigation and operation of the device.
AB191,11,1918 (b) The device may not go upon any roadway except while crossing a roadway
19at a crosswalk.

5Except as otherwise prohibited in this chapter, a personal delivery device operator
6may operate a personal delivery device upon a sidewalk or crosswalk that is under
7the jurisdiction of the department.
AB191,12,118 2. Except as provided in s. 349.236 (1) (c), the department may by rule prohibit
9personal delivery devices upon any sidewalk under its jurisdiction. This subdivision
10does not apply upon any sidewalk at a permanent or temporarily established
11driveway.
AB191,12,1412 (b) A personal delivery device operator may operate a personal delivery device
13upon any sidewalk under the jurisdiction of a local authority, subject to any
14prohibitions specified by municipal ordinance enacted under s. 349.236.
AB191,34 15Section 34 . 346.95 (6) of the statutes is amended to read:

AB191,36 21Section 36. 347.245 (1) of the statutes is amended to read:
AB191,13,1322 347.245 (1) No person may operate on a highway any vehicle or equipment, any
23implement of husbandry, any animal-drawn vehicle, or any other machinery,
24including all road machinery, that usually travels at speeds of less than 25 miles per
25hour or any vehicle operated under a special restricted operator's license issued

1under s. 343.135 or any lightweight utility vehicle, as defined in s. 346.94 (21) (a) 2.,
2unless there is displayed on the most practicable visible rear area of the vehicle or
3combination of vehicles, a slow moving vehicle (SMV) emblem as described in and
4displayed as provided in sub. (2). Any towed vehicle or machine is exempt from this
5provision if the towing vehicle is visible from the rear and is in compliance with this
6section. All road machinery is excluded when it is engaged in actual construction or
7maintenance work either guarded by a flagman or clearly visible warning signs. The
8requirement of the emblem shall be in addition to any lighting devices required or
9permitted by law. Mopeds and motor bicycles are excluded from the provisions of this
10section unless they are operated under a special restricted operator's license issued
11under s. 343.135. Electric personal assistive mobility devices and personal delivery
12devices
are excluded from the provisions of this section. The SMV emblem need not
13be displayed on vehicles moving directly across the highway.
AB191,37 14Section 37. 347.489 (title) of the statutes is amended to read:

electric personal assistive mobility other vehicles and devices.
AB191,38 17Section 38. 347.489 (1) of the statutes is amended to read:
AB191,14,818 347.489 (1) No person may operate a bicycle, motor bicycle, personal delivery
19device,
or electric personal assistive mobility device upon a highway, sidewalk,
20bicycle lane, or bicycle way during hours of darkness unless the bicycle, motor
21bicycle, personal delivery device, or electric personal assistive mobility device is
22equipped with or, with respect to a bicycle or motor bicycle, the operator is wearing,
23a lamp emitting a white light visible from a distance of at least 500 feet to the front
24of the bicycle, motor bicycle, personal delivery device, or electric personal assistive
25mobility device. A bicycle, motor bicycle, personal delivery device, or electric

1personal assistive mobility device shall also be equipped with a red reflector that has
2a diameter of at least 2 inches of surface area or, with respect to an electric personal
3assistive mobility device, that is a strip of reflective tape that has at least 2 square
4inches of surface area, on the rear so mounted and maintained as to be visible from
5all distances from 50 to 500 feet to the rear when directly in front of lawful upper
6beams of headlamps on a motor vehicle. A lamp emitting a steady or flashing red
7light visible from a distance of 500 feet to the rear may be used in lieu of the red
8reflector.
AB191,39 9Section 39. 347.489 (1m) of the statutes is created to read:
AB191,14,1210 347.489 (1m) No person may operate a personal delivery device upon a
11sidewalk unless the device is equipped with a braking system that, when engaged,
12will enable the personal delivery device to come to a controlled stop.
AB191,40 13Section 40. 347.489 (4) of the statutes is created to read:
AB191,14,1714 347.489 (4) No person may operate a personal delivery device upon a sidewalk
15unless the device is equipped with a plate or marker that is in a position to be clearly
16visible and that identifies the name and contact information of the personal delivery
17device operator.

24certain sidewalks, or portions of such sidewalks, under its jurisdiction that are

1designated in the ordinance. This paragraph does not apply to the operation of such
2devices on any sidewalk at a permanent or temporarily established driveway.
AB191,43 3Section 43. 349.236 (1) (c) of the statutes is amended to read:
AB191,15,104 349.236 (1) (c) Designate and mark locations for electric personal assistive
5mobility devices or personal delivery devices to cross a state trunk highway or
6connecting highway that is not a controlled-access highway and on which the
7department has prohibited the operation of electric personal assistive mobility
8devices under s. 346.94 (18) (a) 2. A municipality or county may erect official signs
9or otherwise mark a crossing designated under this paragraph only as directed by
10the department.
AB191,44 11Section 44. 349.236 (2) of the statutes is amended to read:
AB191,15,1512 349.236 (2) Except as otherwise provided in this chapter, ch. 346, and s. 59.84
13(2) (j), the governing body of any municipality or county may not restrict the
14operation of electric personal assistive mobility devices or personal delivery devices
15on any roadway or sidewalk under its jurisdiction.
