AB956,1,3 1An Act to create 20.115 (4) (aw) and 93.495 of the statutes; relating to: grants
2to purchase milk dispensers for schools, granting rule-making authority, and
3making an appropriation.

This bill creates a grant program for purchasing milk dispensers for schools.
Under the bill, the Department of Agriculture, Trade and Consumer Protection must
award grants to school boards, operators of independent charter schools, and
governing bodies of private schools participating in parental choice programs and
the Special Needs Scholarship Program to purchase milk dispensers for schools.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB956,2 1Section 2. 20.115 (4) (aw) of the statutes is created to read:
AB956,2,32 20.115 (4) (aw) Grants for milk dispensers. The amounts in the schedule for
3grants to purchase milk dispensers under s. 93.495.
AB956,3 4Section 3. 93.495 of the statutes is created to read:
AB956,2,5 593.495 Grants for milk dispensers. (1) In this section:
AB956,2,66 (a) “Governing body” means any of the following:
AB956,2,87 1. For a school district, the school board in charge of the schools of the school
8district.
AB956,2,109 2. For a charter school under s. 118.40 (2r) or (2x), the operator of the charter
10school.
AB956,2,1211 3. For a private school participating in a program under s. 115.7915, 118.60,
12or 119.23, the governing body of the private school.
AB956,2,1413 (b) “Milk dispenser” means a machine that stores bulk cold milk and allows
14users to dispense individual servings of milk for immediate consumption.
AB956,2,1715 (c) “School” means a public school, including a charter school under s. 118.40
16(2r) or (2x), or a private school participating in a program under s. 115.7915, 118.60,
17or 119.23.
AB956,3,4 18(2) From the appropriation under s. 20.115 (4) (aw) and subject to sub. (3), the
19department shall award grants to governing bodies to purchase milk dispensers for

1schools. A governing body shall specify in its application for a grant under this
2section the number of milk dispenser units the governing body requests and the cost
3of each unit. The department may award a grant under this section of up to $5,000
4per milk dispenser unit.
AB956,3,7 5(3) If the appropriation under s. 20.115 (4) (aw) in any fiscal year is insufficient
6to pay the full amount requested by all applicants under sub. (2), the department
7shall prorate the payments among the applicants.
AB956,3,9 8(4) The department shall promulgate rules to implement and administer this
9section.
