1995 WISCONSIN ACT 369
An Act to repeal 48.981 (7) (a) 7.; to amend 48.981 (7) (a) 8., 48.981 (7) (a) 10., 48.981 (7) (a) 10g. and 48.981 (7) (a) 11.; and to create 48.981 (7) (a) 2m., 48.981 (7) (a) 2r., 48.981 (7) (a) 10j., 48.981 (7) (a) 11r., 48.981 (7) (a) 14m., 48.981 (7) (a) 15., 48.981 (7) (a) 15m. and 48.981 (7) (a) 17. of the statutes; relating to: the disclosure of child abuse or neglect records and reports.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
369,1m Section 1m. 48.981 (7) (a) 2m. of the statutes is created to read:
48.981 (7) (a) 2m. A person authorized to provide or providing intake or dispositional services for the court under s. 48.067, 48.069 or 48.10.
369,1p Section 1p. 48.981 (7) (a) 2r. of the statutes is created to read:
48.981 (7) (a) 2r. A person authorized to provide or providing intake or dispositional services under s. 938.067, 938.069 or 938.10.
369,1r Section 1r. 48.981 (7) (a) 7. of the statutes is repealed.
369,2 Section 2. 48.981 (7) (a) 8. of the statutes is amended to read:
48.981 (7) (a) 8. A law enforcement officer or agency or a district attorney for purposes of investigation or prosecution.
369,2d Section 2d. 48.981 (7) (a) 10. of the statutes is amended to read:
48.981 (7) (a) 10. A court conducting proceedings under s. 48.21, a court conducting proceedings related to a petition under s. 48.13 or 48.42 or a court conducting dispositional proceedings under subch. VI or VIII in which abuse or neglect of the child who is the subject of the report or record is an issue.
369,2m Section 2m. 48.981 (7) (a) 10g. of the statutes is amended to read:
48.981 (7) (a) 10g. A court conducting proceedings under s. 48.21, a court conducting proceedings related to a petition under s. 48.13 (3m) or (10m) or a court conducting dispositional proceedings under subch. VI in which an issue is the substantial risk of abuse or neglect of a child who, during the time period covered by the report or record, was in the home of the child who is the subject of the report or record.
369,2r Section 2r. 48.981 (7) (a) 10j. of the statutes is created to read:
48.981 (7) (a) 10j. A court conducting proceedings under s. 938.21, a court conducting proceedings relating to a petition under ch. 938 or a court conducting dispositional proceedings under subch. VI of ch. 938 in which abuse or neglect of the child who is the subject of the report or record is an issue.
369,2v Section 2v. 48.981 (7) (a) 11. of the statutes is amended to read:
48.981 (7) (a) 11. The county corporation counsel or district attorney representing the interests of the public and the counsel or guardian ad litem representing the interests of a child in proceedings under subd. 10. or, 10g or 10j.
369,3 Section 3. 48.981 (7) (a) 11r. of the statutes is created to read:
48.981 (7) (a) 11r. A volunteer appointed or person employed by a court-appointed special advocate program recognized by the county board or the county department, to the extent necessary to perform the advocacy services in proceedings related to a petition under s. 48.13 for which the court-appointed special advocate program is recognized by the county board or county department.
369,4 Section 4. 48.981 (7) (a) 14m. of the statutes is created to read:
48.981 (7) (a) 14m. A judge conducting proceedings under s. 968.26.
369,5 Section 5. 48.981 (7) (a) 15. of the statutes is created to read:
48.981 (7) (a) 15. A child fatality review team recognized by the county department.
369,6 Section 6. 48.981 (7) (a) 15m. of the statutes is created to read:
48.981 (7) (a) 15m. A coroner, medical examiner or pathologist or other physician investigating the cause of death of a child whose death is unexplained or unusual or is associated with unexplained or suspicious circumstances.
369,7 Section 7. 48.981 (7) (a) 17. of the statutes is created to read:
48.981 (7) (a) 17. A federal agency, state agency of this state or any other state or local governmental unit located in this state or any other state that has a need for a report or record in order to carry out its responsibility to protect children from abuse or neglect.
369,7m Section 7m. Effective dates. This act takes effect on the day after publication, except as follows:
(1)The treatment of section 48.981 (7) (a) 2r., 10j. and 11. of the statutes takes effect on July 1, 1996, or on the day after publication, whichever is later.
