1995 WISCONSIN ACT 446
An Act to amend 343.20 (2m) and 343.50 (6); and to create 110.08 (1m), 343.01 (2) (dg), 343.175 (1r) and 343.50 (4m) of the statutes; relating to: driver's licenses and identification cards issued by the department of transportation and anatomical donations.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
446,2 Section 2 . 110.08 (1m) of the statutes is created to read:
110.08 (1m) Each operator's license examiner shall receive informational training on the powers and duties of the department relating to organ donor information under s. 343.175 once every 2 years and, for operator's license examiners hired after the effective date of this subsection .... [revisor inserts date], prior to initial assignment to operator's license examining activities. The informational training under this subsection shall be developed by all organ procurement organizations, as defined in s. 343.01 (2) (dg), in cooperation with the department.
446,3 Section 3 . 343.01 (2) (dg) of the statutes is created to read:
343.01 (2) (dg) “Organ procurement organization" means an organization that has status as a designated organ procurement organization under the requirements of 42 CFR 485.303.
446,5 Section 5 . 343.175 (1r) of the statutes is created to read:
343.175 (1r) Department to provide information. In addition to the inquiry under sub. (1), if the applicant is at least 18 years of age, the department shall orally state to the applicant that he or she has the opportunity to indicate his or her willingness to be an organ donor. If the applicant indicates that he or she is undecided in response to the inquiry under sub. (1), the department shall provide the applicant with written information that all organ procurement organizations and the department have together developed. If the applicant makes an affirmative response to the inquiry under sub. (1), the department shall request at that time that the applicant write on the license the information that is specified under sub. (2) (ar) and affix a sticker, as described in sub. (3) (a), to the front side of the license document.
446,7 Section 7 . 343.20 (2m) of the statutes is amended to read:
343.20 (2m) The department shall include with the notice that it mails under sub. (2) information regarding the requirements of s. 347.48 (4); information, as developed by all organ procurement organizations in cooperation with the department, that promotes anatomical donations and which relates to the anatomical donation opportunity available under s. 343.175; and, for licensees aged 65 years or older, material, as provided by the department, explaining the voluntary program that is specified in s. 71.55 (10) (b).
446,8m Section 8m. 343.50 (4m) of the statutes is created to read:
343.50 (4m) Organ donor information. (a) As part of every application for an identification card, the department shall inquire whether the applicant desires to be an organ donor. The department shall record the organ donor response in its file of the person.
(b) In addition to the inquiry under par. (a), if the applicant is at least 18 years of age, the department shall orally state to the applicant that he or she has the opportunity to indicate his or her willingness to be an organ donor. If the applicant indicates that he or she is undecided in response to the inquiry under par. (a), the department shall provide the applicant with written information that all organ procurement organizations and the department have together developed. If the applicant makes an affirmative response to the inquiry under par. (a), the department shall request at that time that the applicant write on the identification card the information that is required to make an anatomical gift under s. 157.06 (2) (b) and (c) and affix a sticker thereto as provided in s. 343.175 (3).
446,9e Section 9e. 343.50 (6) of the statutes is amended to read:
343.50 (6) Renewals. At least 30 days prior to the expiration of the card, the department shall mail a renewal application to the last-known address of each identification card holder. The department shall include with the application information, as developed by all organ procurement organizations in cooperation with the department, that promotes anatomical donations and which relates to the anatomical donation opportunity available under s. 343.175. The fee for a renewal identification card shall be $4, which card shall be valid for 4 years.
446,11 Section 11 . Effective date.
(1)This act takes effect on the first day of the 6th month beginning after publication.
