11provide payment to a relative, other than a parent, who is providing care and
12maintenance for a child, eliminating postsecondary education and vocational
13skills training from the job opportunities and basic skills program, applying the
14learnfare provisions statewide to certain individuals who are 6 to 19 years of
15age, eliminating child care funded under community aids, modifying eligibility
16requirements for low-income and at-risk child care, creating a tax exemption,
17making modifications to the job opportunities and basic skills program, making
18modifications to the food stamp employment and training program,
19consolidating state general purpose revenue appropriations for public
20assistance and local aid, providing an exemption from emergency rule
21procedures, providing an exemption from rule-making procedures, granting
22rule-making authority and making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB591-ASA1, s. 1 23Section 1. 13.101 (6) (a) of the statutes is amended to read:

113.101 (6) (a) As an emergency measure necessitated by decreased state
2revenues and to prevent the necessity for a state tax on general property, the
3committee may reduce any appropriation made to any board, commission,
4department, the university of Wisconsin system or to any other state agency or
5activity by such amount as it deems feasible, not exceeding 25% of the
6appropriations, except appropriations made by ss. 20.255 (2) (ac), (bc), (bh), (bm), (cg)
7and (cr), 20.395 (1), (2) (cq), (eq) to (ex) and (gq) to (gx), (3), (4) (aq) to (ax) and (6) (aq)
8and (ar), 20.435 (4) (a), (d) (dz) and (e), (6) (a) and (7) (da) or for forestry purposes
9under s. 20.370 (1), or any other moneys distributed to any county, city, village, town
10or school district. Appropriations of receipts and of a sum sufficient shall for the
11purposes of this section be regarded as equivalent to the amounts expended under
12such appropriations in the prior fiscal year which ended June 30. All functions of
13said state agencies shall be continued in an efficient manner, but because of the
14uncertainties of the existing situation no public funds should be expended or
15obligations incurred unless there shall be adequate revenues to meet the
16expenditures therefor. For such reason the committee may make reductions of such
17appropriations as in its judgment will secure sound financial operations of the
18administration for said state agencies and at the same time interfere least with their
19services and activities.
AB591-ASA1, s. 2 20Section 2. 13.101 (6) (a) of the statutes, as affected by 1995 Wisconsin Acts 27
21and .... (this act), is repealed and recreated to read:

21stations are located in an area designated by the department comprising the central

AB591-ASA1,7,133 20.435 (1) (b) Medical assistance program benefits. Biennially, the amounts in
4the schedule to provide the state share of medical assistance program benefits
5administered under s. 49.45, to provide medical assistance program benefits
6administered under s. 49.45 that are not also provided under par. (o), to provide
7health care coverage under s. 49.153
and to fund the pilot project under s. 46.27 (9)
8and (10). Notwithstanding s. 20.002 (1), the department may transfer from this
9appropriation to the appropriation under sub. (3) (kb) funds in the amount of and for
10the purposes specified in s. 46.485. Notwithstanding ss. 20.001 (3) (b) and 20.002 (1),
11the department may credit or deposit into this appropriation and may transfer
12between fiscal years funds that it transfers from the appropriation under sub. (3) (kb)

AB591-ASA1,8,515 20.435 (1) (bm) Medical assistance administration. Biennially, the amounts
16in the schedule to provide the state share of administrative contract costs for the
17medical assistance program under s. 49.45 and health care coverage under s. 49.153
18and to reimburse insurers for their costs under s. 49.475. No state positions may be

1funded in the department of health and social services from this appropriation,
2except positions for the performance of duties under a contract in effect before
3January 1, 1987, related to the administration of the medical assistance program
4between the subunit of the department primarily responsible for administering the
5medical assistance program and another subunit of the department.

146.03 (21) Day care standards. Promulgate rules establishing standards for
2the certification of day care providers under s. 48.651. In establishing standards for
3certification under s. 48.651 (1) (b), the department may not include a requirement
4for training for child care providers certified under s. 48.651 (1) (b).
AB591-ASA1, s. 26 5Section 26. 46.032 of the statutes is amended to read:
AB591-ASA1,12,15 646.032 Income maintenance administration. County departments under
7ss. 46.215, 46.22 and 46.23 shall annually enter into a contract with the department
8detailing the reasonable cost of administering the income maintenance programs
9under ss. 49.046, 49.19, 49.45 to 49.47 and 49.50 (7) and the food stamp program
10under 7 USC 2011 to 2029 when so appointed by the department. Contracts created
11under this section control the distribution of payments under s. 20.435 (4) (de) (dz)
12and (nL) in accordance with the reimbursement method established under s. 49.52
13(1) (ad). The department may reduce its payment to any county under s. 20.435 (4)
14(de) (dz) and (nL) if federal reimbursement is withheld due to audits, quality control
15samples or program reviews.
AB591-ASA1, s. 27 16Section 27. 46.032 of the statutes, as affected by 1995 Wisconsin Acts 27,
17section 2042, and .... (this act), is repealed and recreated to read:
AB591-ASA1,13,2 1846.032 Income maintenance administration. County departments under

7services may certify eligibility for and distribute surplus commodities and food
