The Honorable, The Legislature:
The 1995 Wisconsin Act 27 requires the Department of Health and Social Services to develop a policy to address the use of scheduled and unscheduled leave, including sick leave by employees of the juvenile correctional institutions. The division of Youth Services (DYS) has begun discussions with AFSCME Council 24 Wisconsin State Employees Union AFL-CIO and its Appropriate Affiliated Locals to inform them of this statutory requirement.
Before any policy can be implemented, it must follow the procedure outlined in the WSEU union contract. For example, a 30-day advance notice of the written policy must be provided to the local unions and to all current employees. Because biennial union/management negotiations have precedent, time was not sufficient to complete a new sick leave policy.
As an interim measure, DYS will implement measures to reduce the use of overtime and will continue discussions with the union to implement the directive for the Legislature. Because DYS will be transferring to the Department of Corrections (DOC) July, 1996, DYS must seek input from DOC and local unions prior to implementation of any changes in sick leave policy.
The attached report outlines the background of the issues, current steps being taken to control overtime, and the implementation process DYS will be following.
