(2) The department shall promulgate rules for the procurement of
19contractual services, including but not limited to the approval and monitoring
20processes for contractual service contracts. Each officer requesting approval to
21engage any person to perform contractual services shall submit to the department
22written justification for such contracting which shall include a description of the
23contractual services to be procured, justification of need, justification for not
24contracting with other agencies, a specific description of the scope of contractual
1services to be performed, and justification for the procurement process if a process
2other than competitive bidding is to be used. The department may not approve any
3contract for contractual services unless it is satisfied that the justification for
4contracting conforms to the requirements of this section and ss. 16.71 to 16.77.
This
5subsection does not apply to contracts entered into under s. 16.707.

14department of administration, in consultation with the department of corrections,
15shall request the submittal of competitive sealed proposals for the initial operation
16and management of the medium security correctional facility authorized under 1997
17Wisconsin Act .... (this act), section 9107 (1) (b). If more than one such facility is
18constructed, the department of administration shall request the submittal of
19competitive sealed proposals for the initial operation and management of one such
20facility.

21(2) The term of the initial operation and management of the facility specified
22in sub. (1) may be specified by the department of administration in its request for
23proposals. If the department of administration does not specify a term, a vendor may
24specify a term in its proposal which may not exceed the maximum term specified by

1(3) No later than the deadline specified by the department of administration
2for receipt of proposals under sub. (1), the department of corrections shall provide to

23prison industries, as created under s. 303.01. The department of administration
24shall distribute the list to all designated purchasing agents under s. 16.71 (1).

1Except as required under s. 16.707, prior to seeking bids or competitive sealed
2proposals with respect to the purchase of any materials, supplies, equipment or
3contractual services enumerated in the list, the department of administration or any
4other designated purchasing agent under s. 16.71 (1) shall offer prison industries the
5opportunity to supply the materials, supplies, equipment or contractual services if
6the department of corrections is able to provide them at a price comparable to one
7which may be obtained through competitive bidding or competitive sealed proposals
8and is able to conform to the specifications, provided the specifications are written
9in accordance with s. 16.72 (2) (d). If the department of administration or other
10purchasing agent is unable to determine whether the price of prison industries is
11comparable, it may solicit bids or competitive proposals before awarding the order
