Amendment ASA1-AB100

AB100-ASA1,32,19 15.374 (1) Office of educational accountability. There is created an office of educational accountability in the department of education public instruction. The director of the office shall be appointed by the secretary of education state superintendent of public instruction.

AB100-ASA1, s. 57 Section 57. 15.375 (1) of the statutes is amended to read:

AB100-ASA1,33,11 15.375 (1) American Indian language and culture education board. There is created an American Indian language and culture education board which is attached to the department of education public instruction under s. 15.03. The board shall consist of 13 members appointed by the governor for staggered 4-year terms from recommendations made by the various Indian tribes, bands and organizations in this state. The members shall include parents or guardians of American Indian children, American Indian teachers, school administrators, a school board member, persons involved in programs for American Indian children and persons experienced in the training of teachers for American Indian language and culture education programs. Members shall be appointed so as to be representative of all the American Indian tribes, bands and organizations in this state. In addition to its duties under subch. IV of ch. 115, the board shall advise the secretary of education state superintendent of public instruction, the board of regents of the university of Wisconsin system, the department of education higher educational aids board and the technical college system board on all matters relating to the education of American Indians. The board does not have rule-making authority.

AB100-ASA1, s. 58 Section 58. 15.375 (2) of the statutes is amended to read:

AB100-ASA1,33,23 15.375 (2) School district boundary appeal board. There is created a school district boundary appeal board in the department of education public instruction. The board shall consist of 12 school board members appointed by the secretary of education state superintendent of public instruction for staggered 2-year terms and the secretary of education state superintendent of public instruction or his or her designee. Four board members shall be school board members of school districts with small enrollments, 4 board members shall be school board members of school districts with medium enrollments and 4 board members shall be school board members of school districts with large enrollments. No 2 school board members of the board may reside within the boundaries of the same cooperative educational service agency.

AB100-ASA1, s. 75m Section 75m. 15.375 (3) of the statutes is renumbered 15.915 (6), and 15.915 (6) (a) and (b) 1. and 6. (intro.), as renumbered, are amended to read:

AB100-ASA1,34,3 15.915 (6) (a) Creation. There is created an environmental education board attached to the department of education University of Wisconsin System under s. 15.03.

AB100-ASA1, s. 59 Section 59. 15.377 (1) of the statutes is amended to read:

AB100-ASA1,34,18 15.377 (1) Council on the education of the blind. There is created in the department of education public instruction a council on the education of the blind consisting of 3 members, who shall be visually handicapped and shall have a recognized interest in and a demonstrated knowledge of the problems of the visually handicapped, appointed by the secretary of education state superintendent of public instruction for staggered 6-year terms. "Visually handicapped" means having a) a visual acuity equal to or less than 20/70 in the better eye with correcting lenses, or b) a visual acuity greater than 20/70 in the better eye with correcting lenses, but accompanied by a limitation in the field of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees.

AB100-ASA1, s. 60 Section 60. 15.377 (2) of the statutes is amended to read:

AB100-ASA1,34,25 15.377 (2) Governor's council on business and education partnerships. There is created in the department of education public instruction a council on business and education partnerships consisting of representatives of private business and industry, agriculture, organized labor, the technical college system and the public school system. A majority of the members shall be representatives of private business and industry. Council members shall be appointed for 3-year terms.

AB100-ASA1, s. 61 Section 61. 15.377 (3) of the statutes is amended to read:

AB100-ASA1,35,9 15.377 (3) Council on instructional telecommunications. There is created in the department of education public instruction a council on instructional telecommunications. The secretary of education state superintendent of public instruction shall appoint one member to represent each of the cooperative educational service agencies, from nominations made by the boards of control of the cooperative educational service agencies, and 2 members to represent private primary and secondary educational institutions. Council members shall be appointed for 4-year terms.

AB100-ASA1, s. 62 Section 62. 15.377 (4) of the statutes is amended to read:

AB100-ASA1,35,21 15.377 (4) Council on exceptional education. There is created in the department of education public instruction a council on exceptional education consisting of 15 members appointed by the secretary of education state superintendent of public instruction for 3-year terms. No more than 7 members of the council may be persons who do not have children with exceptional educational needs and who are representatives of the state, school districts, county handicapped children's education boards or cooperative educational service agencies. At least 5 members of the council shall be parents or guardians of a child with exceptional educational needs, at least one member of the council shall be a school board member, at least one member shall be a certified teacher of regular education as defined in s. 115.76 (9) and at least one member shall be a certified teacher of special education.

AB100-ASA1, s. 63 Section 63. 15.377 (6) of the statutes is amended to read:

AB100-ASA1,36,9 15.377 (6) Council on library and network development. There is created in the department of education public instruction a council on library and network development composed of 15 members. Seven of the members shall be library science, audiovisual and informational science professionals representative of various types of libraries and information services, including public libraries, public library systems, school libraries, public and private academic libraries, special libraries and library educators. Eight of the members shall be public members who have demonstrated an interest in libraries or other types of information services. The members of the council shall be appointed for 3-year terms. The council shall meet 6 times annually and shall also meet on the call of the secretary of education state superintendent of public instruction, and may meet at other times on the call of the chairperson or a majority of its members.

AB100-ASA1, s. 64 Section 64. 15.377 (7m) of the statutes is amended to read:

AB100-ASA1,36,21 15.377 (7m) Council on suicide prevention. There is created a council on suicide prevention in the department of education public instruction. The council shall consist of 2 persons appointed by the secretary of education state superintendent of public instruction, at least one of whom is not an employe of the department of education public instruction, 2 persons appointed by the secretary of health and social services, at least one of whom is not an employe of the department of health and social services, one person and one physician appointed jointly by the secretary of education state superintendent of public instruction and the secretary of health and social services and one person appointed by the executive staff director of the office of justice assistance in the department of administration. Members shall be appointed for 3-year terms.

AB100-ASA1, s. 83e Section 83e. 15.405 (7c) (a) of the statutes is amended to read:

AB100-ASA1,37,10 15.405 (7c) (a) There is created an examining board of social workers, marriage and family therapists and professional counselors in the department of regulation and licensing. The members of the examining board shall be appointed for 4-year terms. Four Five members shall be certified under ch. 457 as social workers. Three members shall be certified under ch. 457 as marriage and family therapists. Three members shall be certified under ch. 457 as professional counselors. Three members shall be public members. Of the 4 5 certified social worker members, one shall be certified under ch. 457 as an advanced practice social worker, one shall be certified under ch. 457 as an independent social worker, one shall be certified under ch. 457 as an independent clinical social worker, one shall have received a doctorate degree in sociology, psychology, criminal justice or other human service field and shall hold a faculty appointment at a college or university in this state and at least one shall be employed as a social worker by a federal, state or local governmental agency.

AB100-ASA1, s. 83m Section 83m. 15.405 (7c) (b) of the statutes is amended to read:

AB100-ASA1,37,20 15.405 (7c) (b) In operation, the examining board shall be divided into a social worker section, a marriage and family therapist section and a professional counselor section. The social worker section shall consist of the 4 5 social worker members of the examining board and one of the public members of the examining board. The marriage and family therapist section shall consist of the 3 marriage and family therapist members of the examining board and one of the public members of the examining board. The professional counselor section shall consist of the 3 professional counselor members of the examining board and one of the public members of the examining board.

AB100-ASA1, s. 83s Section 83s. 15.405 (7c) (f) of the statutes is amended to read:

AB100-ASA1,38,2 15.405 (7c) (f) At a joint meeting of the social worker section and one or both of the other sections of the examining board, each member who is present has one vote, except that the social worker members each have three-fourths of a vote if all 4 of those members are present and have three-fifths of a vote if all 5 of those members are present.

AB100-ASA1, s. 65 Section 65. 15.435 (2) of the statutes is repealed.

AB100-ASA1, s. 66 Section 66. 15.57 (1) of the statutes is amended to read:

AB100-ASA1,38,7 15.57 (1) The secretary of administration, the secretary of education state superintendent of public instruction, the president of the university of Wisconsin system and the director of the technical college system board, or their designees.

AB100-ASA1, s. 67 Section 67. 15.64 of the statutes is repealed.

AB100-ASA1, s. 68 Section 68. 15.643 of the statutes is repealed.

AB100-ASA1, s. 69 Section 69. 15.647 (title) of the statutes is repealed.

AB100-ASA1, s. 70 Section 70. 15.647 (1) of the statutes is renumbered 15.107 (18) and amended to read:

AB100-ASA1,38,17 15.107 (18) Council on charitable gaming. There is created in the gaming board department of administration a council on charitable gaming consisting of 5 residents of this state appointed for 5-year terms. Not more than 3 members of the council may belong to the same political party. Members of the council shall hold office until a successor is appointed and qualified.

AB100-ASA1, s. 90m Section 90m. 15.67 of the statutes is created to read:

AB100-ASA1,38,23 15.67 Higher educational aids board; creation. (1) There is created a higher educational aids board consisting of the state superintendent of public instruction and the following members appointed for 3-year terms, except that the members specified under pars. (a) 5. and 6. and (b) 3. shall be appointed for 2-year terms:

AB100-ASA1,38,24 (a) To represent public institutions of higher education, all of the following:

AB100-ASA1,38,25 1. One member of the board of regents of the University of Wisconsin System.

AB100-ASA1,39,1 2. One member of the technical college system board.

AB100-ASA1,39,2 3. One financial aids administrator within the University of Wisconsin System.

AB100-ASA1,39,3 4. One financial aids administrator within the technical college system.

AB100-ASA1,39,6 5. One undergraduate student enrolled at least half-time and in good academic standing at an institution or center within the University of Wisconsin System who is at least 18 years old and a resident of this state.

AB100-ASA1,39,8 6. One student enrolled at least half-time and in good academic standing at a technical college who is at least 18 years old and a resident of this state.

AB100-ASA1,39,10 (b) To represent private, nonprofit institutions of higher education, all of the following:

AB100-ASA1,39,12 1. One member of a board of trustees of an independent college or university in this state.

AB100-ASA1,39,14 2. One financial aids administrator of a private nonprofit institution of higher education located in this state.

AB100-ASA1,39,17 3. One undergraduate student enrolled at least half-time and in good academic standing at a private, nonprofit institution of higher education located in this state who is at least 18 years old and a resident of this state.

AB100-ASA1,39,18 (c) One member to represent the general public.

AB100-ASA1,39,22 (2) If a student member under sub. (1) loses the status upon which the appointment was based, he or she shall cease to be a member of the higher educational aids board upon appointment to the higher educational aids board of a qualified successor.

AB100-ASA1, s. 71 Section 71. 15.675 of the statutes is created to read:

AB100-ASA1,40,3 15.675 Same; attached board. (1) Educational approval board. There is created an educational approval board which is attached to the higher educational aids board under s. 15.03. The board shall consist of not more than 7 members, who shall be representatives of state agencies and other persons with a demonstrated interest in educational programs, appointed to serve at the pleasure of the governor.

AB100-ASA1, s. 72 Section 72. 15.707 (1) of the statutes is amended to read:

AB100-ASA1,40,13 15.707 (1) Historical markers council. There is created in the historical society a historical markers council. The council shall consist of the director of the historical society, the secretary of education state superintendent of public instruction, the secretary of transportation, the secretary of natural resources, the secretary of tourism, the secretary of veterans affairs, the chairperson of the historic preservation review board, the president of the Wisconsin trust for historic preservation and the president of the Wisconsin council for local history, or their designees. The director of the historical society or a designee shall serve as secretary of the council.

AB100-ASA1, s. 92m Section 92m. 15.707 (3) of the statutes is created to read:

AB100-ASA1,40,17 15.707 (3) Historical society endowment fund council. There is created in the historical society a historical society endowment fund council consisting of 10 members, including at least one representative of each of the following:

AB100-ASA1,40,18 (a) The historical society.

AB100-ASA1,40,19 (b) The Wisconsin Humanities Council.

AB100-ASA1,40,20 (c) The Wisconsin Academy of Science, Arts and Letters.

AB100-ASA1,40,23 (f) Wisconsin public television.

AB100-ASA1, s. 73 Section 73. 15.735 (2) of the statutes is renumbered 15.195 (6) and amended to read:

AB100-ASA1,41,5 15.195 (6) Board on health care information. There is created a board on health care information which is attached to the office of the commissioner of insurance department of health and family services under s. 15.03. The board shall consist of 9 members, a majority of whom may neither be nor represent health care providers, appointed for 4-year terms.

AB100-ASA1, s. 74 Section 74. 15.737 of the statutes is repealed.

AB100-ASA1, s. 96m Section 96m. 16.009 (1) (em) 7. of the statutes is created to read:

AB100-ASA1,41,9 16.009 (1) (em) 7. A residential care apartment complex, as defined in s. 50.01 (1d).

AB100-ASA1, s. 96r Section 96r. 16.0095 of the statutes is created to read:

AB100-ASA1,41,18 16.0095 Medicare upper limit consultant. The department shall hire a consultant to determine and recommend to the the department of health and family services the aggregate payments that should be made for inpatient nursing home services under medical assistance under subch. IV of ch. 49 such that the aggregate payments will not exceed the amount that is estimated to be the amount that would have been paid under the federal medicare program's payment principles. The consultant's recommendations to the department of health and family services shall be nonbinding.

AB100-ASA1, s. 75 Section 75. 16.023 of the statutes is created to read:

AB100-ASA1,41,21 16.023 Wisconsin land council. (1) The Wisconsin land council shall conduct the following functions:

AB100-ASA1,41,22 (a) Identify state land use goals and recommend these goals to the governor.

AB100-ASA1,41,24 (b) Identify state land use priorities to further the state's land use goals and recommend to the governor legislation to implement these priorities.

AB100-ASA1,42,3 (c) Study areas of cooperation and coordination in the state's land use statutes and recommend to the governor legislation to harmonize these statutes to further the state's land use goals.

AB100-ASA1,42,6 (d) Study areas of the state's land use statutes that conflict with each other and recommend to the governor legislation to resolve these conflicts to further the state's land use goals.

AB100-ASA1,42,10 (e) Identify areas of the state's land use statutes that conflict with county or municipal land use ordinances, and areas of county or municipal land use ordinances that conflict with each other, and recommend to the governor legislation to resolve these conflicts.

AB100-ASA1,42,16 (f) Establish a technical working group that is composed of the state cartographer, a representative of the University of Wisconsin System who has expertise in land use issues and any other land use experts designated by the council's chairperson, to study the development of a computer-based Wisconsin land information system and recommend to the governor legislation to implement such a computer system.

AB100-ASA1,42,21 (g) Establish a state agency resource working group that is composed of representatives of the departments of administration, agriculture, trade and consumer protection, commerce, natural resources, revenue, transportation and other appropriate agencies to discuss, analyze and address land use issues and related policy issues, including the following:

AB100-ASA1,42,22 1. Gathering information about the land use plans of state agencies.

AB100-ASA1,42,24 2. Establishing procedures for the distribution of the information gathered under subd. 1. to other state agencies, local units of government and private persons.

AB100-ASA1,43,2 3. The creation of a system to facilitate, and to provide training and technical assistance for the development of, local intergovernmental land use planning.

AB100-ASA1,43,6 (h) Study the activities of local units of government in the land use area to determine how these activities impact on state land use goals, and recommend to the governor legislation that fosters coordination between local land use activities and state land use goals.

AB100-ASA1,43,9 (i) Identify procedures for facilitating local land use planning efforts, including training and technical assistance for local units of government, and recommend to the governor legislation to implement such procedures.

AB100-ASA1,43,12 (j) Gather and analyze information about the land use activities in this state of the federal government and American Indian governments and inform the governor of the impact of these activities on state land use goals.

AB100-ASA1,43,16 (k) Study any other issues that are reasonably related to the state's land use goals, including methods for alternative dispute resolution for disputes involving land use issues, and recommend to the governor legislation in the areas studied by the council that would further the state's land use goals.

AB100-ASA1,43,18 (L) Gather information about land use issues, at its discretion, in any reasonable way, including the following:

AB100-ASA1,43,20 1. Establishing a state-local government-private sector working group to study and advise the council on land use issues.

AB100-ASA1,43,21 2. Holding public hearings or information meetings on land use issues.

AB100-ASA1,43,22 3. Conducting surveys on land use issues.
