SENATE AMENDMENT 1, TO 1997 ASSEMBLY BILL 342

AB342-SA1,1,1 At the locations indicated, amend the engrossed billbill as follows:

AB342-SA1,1,2 1. Page 36, line 13: delete lines 13 and 14 and substitute:

AB342-SA1,1,3 " Section 94e. 950.08 (3) (title) of the statutes is created to read:

AB342-SA1,1,4 950.08 (3) (title) Duties of department; mediation.

AB342-SA1, s. 94f Section 94f. 950.08 (3) of the statutes is renumbered 950.08 (3) (a) and amended to read:

AB342-SA1,1,7 950.08 (3) (a) The Subject to par. (b), the department may".

AB342-SA1,1,8 2. Page 36, line 22: after that line insert:

AB342-SA1,1,9 " Section 94m. 950.08 (3) (b) of the statutes is created to read:

AB342-SA1,2,3 950.08 (3) (b) If the department receives a complaint regarding the treatment of crime victims or witnesses by a judge or a district attorney, the department may not act on the complaint under par. (a) unless the judge or district attorney consents to the department acting under par. (a). If a judge or district attorney does not consent to the department acting under par. (a), the department shall immediately refer the complaint to the judicial commission if it concerns a judge or to the board of attorneys professional responsibility if it concerns a district attorney.".

Page 37, line 3: after "victim" insert ", except that if the complaint concerns a violation or alleged violation of the rights of crime victims by a judge or a district attorney the board may not review the complaint but shall immediately refer the complaint to the judicial commission if it concerns a judge or to the board of attorneys professional responsibility if it concerns a district attorney".

AB342-SA1,2,12 5. Page 40, line 16: after the period insert "Only the crime victims rights board acting under s. 950.09 (2) (d) may bring an action to assess a forfeiture under this section.".
