(3) Eligibility. (intro.) The department shall determine those
5prisoners who are confined under sub. (1). Except as provided in
sub. subs. (3m)

6(3t), a prisoner is eligible for this confinement only under all of the following

10prisoner serving a bifurcated sentence imposed under s. 973.01 is not eligible for
11confinement under sub. (1) during the term of confinement in prison portion of the
12bifurcated sentence.".

(2) (b) He or she is a prisoner serving a felony sentence not punishable
4by life imprisonment and the department directs him or her to participate in the
5program.
This paragraph does not apply to a prisoner serving a bifurcated sentence

(1) Sentence. Beginning July 1, 1992, a court may sentence a person
16who is convicted of a felony occurring on or after August 15, 1991,
but before July 1,
171998, to participate in the intensive sanctions program under s. 301.048.
If a person
18is convicted of a felony occurring on or after July 1, 1998, a court may not sentence
19the person to participate in the intensive sanctions program under s. 301.048.".
