17Definitions. In this section:
AB100-engrossed,543,1818 (a) "Band" means the Lac du Flambeau band of Lake Superior Chippewa.
AB100-engrossed,543,2019 (b) "Reservation" means the territory within the boundaries of the Lac du
20Flambeau reservation that were in existence on April 10, 1996.
AB100-engrossed,543,24 21(2) Authorization for issuance. The band may issue one or more types of
22fishing approvals that are equivalent to one or more of the the following types of
23approvals by authorizing the same types of fishing by the same persons and in the
24same bodies of water:
AB100-engrossed,543,2525 (a) Nonresident annual fishing licenses.
AB100-engrossed,544,1
1(b) Nonresident 15-day fishing licenses.
AB100-engrossed,544,22 (c) Nonresident 4-day fishing licenses.
AB100-engrossed,544,33 (d) Nonresident annual family fishing licenses.
AB100-engrossed,544,44 (e) Nonresident 15-day family fishing licenses.
AB100-engrossed,544,55 (f) Nonresident 2-day sports fishing licenses.
AB100-engrossed,544,66 (g) Resident annual fishing licenses.
AB100-engrossed,544,77 (h) Resident 2-day sports fishing licenses.
AB100-engrossed,544,88 (i) Husband and wife fishing licenses.
AB100-engrossed,544,99 (j) Inland waters trout stamps.
AB100-engrossed,544,13 10(3) Requirements for issuance; fees; periods of validity. (a) For any approval
11issued under this section, the band shall collect the same amount that would be
12collected for the equivalent approval under s. 29.092, including the issuing fee under
13s. 29.092 (15). The band shall retain all of the fees collected under this paragraph.
AB100-engrossed,544,1514 (b) The band may not issue or sell approvals under this section in conjunction
15with discount coupons or as part of a promotion or other merchandising offer.
AB100-engrossed,544,1716 (c) For any approval issued under this section, the period of validity shall be
17the same as it would be for the equivalent approval under s. 29.093.
AB100-engrossed,544,1918 (d) The band may issue duplicates only for the approvals that it issues under
19this section.
AB100-engrossed,544,2120 (e) The band may issue approvals under this section only to applicants who
21appear in person on the reservation.
AB100-engrossed,545,4 22(4) Issuance; processing; records. (a) The band shall prepare, procure the
23printing of and supply all necessary approval blanks and applications for approvals
24issued under this section. Approval blanks and applications used under this section
25shall be numbered consecutively, at the time of printing, in a separate series for each

1kind of approval. Each license blank issued under this section shall be provided with
2a corresponding stub or carbon numbered with the serial number of the license. Each
3requisition for the printing of such approval blanks shall specify any serial numbers
4to be printed on the blanks.
AB100-engrossed,545,75 (b) Each license issued under this section shall bear on its face the signature
6of the licensee, the date of issuance and the signature of the issuing agent. All
7licenses shall be issued in English and in ink.
AB100-engrossed,545,118 (c) Before June 1 annually, the band shall submit a report to the department
9notifying it of the number of each type of approval that the band issued for the period
10beginning on April 1 of the previous year and ending on March 31 of the year in which
11the report is submitted.
AB100-engrossed,545,1412 (d) For law enforcement purposes, persons issuing approvals under this section
13shall make available for inspection by the department during normal business hours
14their records of all approvals issued, including copies of all licenses issued.
AB100-engrossed,545,1715 (e) The band shall ensure that a record of each approval issued under this
16section, including a copy of each license issued, is retained for at least 2 years after
17the date of expiration of the license.
AB100-engrossed,545,1918 (f) Sections 29.09 (2), (3) (b), (3m) (b), (4), (8) and (10) (b) and (c) and 29.092 (3r)
19do not apply to any approval that may be issued under this section.
AB100-engrossed,545,24 20(5) Restrictions on approvals. A person who is fishing under the authority of
21an approval issued under this section shall be subject to the same conditions,
22limitations and restriction as are imposed on the equivalent approval issued under
23s. 29.14, 29.145, 29.146. 29.147 or 29.149, including bag limits, size limits, rest days
24and closed seasons.

1(6) Applicability. This section does not apply unless the department and the
2band have in effect a written agreement, approved by the joint committee on finance,
3under which the band agrees to comply with subs. (2) to (4) and that contains all of
4the following terms:
AB100-engrossed,546,65 (a) The manner in which the band will limit its treaty-based right to fish
6outside the reservation.
AB100-engrossed,546,87 (b) A requirement that the fees collected by the band under sub. (3) (a) be used
8only for fishery management within the reservation.
AB100-engrossed, s. 1042 9Section 1042. 29.139 of the statutes is created to read:
AB100-engrossed,546,11 1029.139 Department approvals issued on the Lac du Flambeau
11reservation.
(1) Definitions. In this section:
AB100-engrossed,546,1212 (a) "Band" means the Lac du Flambeau band of Lake Superior Chippewa.
AB100-engrossed,546,1413 (b) "Reservation" means the territory within the boundaries of the Lac du
14Flambeau reservation that were in existence on April 10, 1996.
AB100-engrossed,546,16 15(2) Authorization. The band may elect to issue one or more of the following
16types of approvals, subject to s. 29.09, as an agent of the department:
AB100-engrossed,546,1717 (a) Nonresident annual fishing licenses.
AB100-engrossed,546,1818 (b) Nonresident 15-day fishing licenses.
AB100-engrossed,546,1919 (c) Nonresident 4-day fishing licenses.
AB100-engrossed,546,2020 (d) Nonresident annual family fishing licenses.
AB100-engrossed,546,2121 (e) Nonresident 15-day family fishing licenses.
AB100-engrossed,546,2222 (f) Nonresident 2-day sports fishing licenses.
AB100-engrossed,546,2323 (g) Resident annual fishing licenses.
AB100-engrossed,546,2424 (h) Resident 2-day sports fishing licenses.
AB100-engrossed,546,2525 (i) Husband and wife fishing licenses.

1(j) Inland waters trout stamps.
AB100-engrossed,547,22 (k) Resident sports licenses.
AB100-engrossed,547,33 (L) Nonresident sports licenses.
AB100-engrossed,547,7 4(3) Fees; issuance. (a) The band shall collect the fee for an approval issued
5under sub. (2) in the same amount as is collected by the department for the approval,
6including the issuing fee. Except as provided in par. (b), the band shall retain the
7entire fee that it collects, including the issuing fee.
AB100-engrossed,547,108 (b) For a resident or nonresident sports license, the band shall retain only the
9amount that is equal to the fee for an annual fishing license plus the issuing fee and
10shall remit the balance to the department.
AB100-engrossed,547,1311 (c) For a resident or nonresident sports license, in addition to the fees collected
12under par. (a), the band shall collect the wildlife damage surcharge and remit it to
13the department.
AB100-engrossed,547,1514 (d) The band may issue approvals under this section only to applicants who
15appear in person on the reservation.
AB100-engrossed,547,18 16(4) Revenues from issuance of department approvals on the reservation by
17others.
(a) Annually, the department may pay to the band an amount for the
18issuance of the approvals specified in sub. (2) (a) to (L) within the reservation.
AB100-engrossed,547,2019 (b) If the department decides that it will make the payment under par. (a), it
20shall calculate the total amount of the payment to equal the sum of the following:
AB100-engrossed,547,2321 1. The amount in fees received by the department from the issuance of the
22approvals specified in sub. (2) (a) to (j) during the preceding year by issuing agents
23other than the band at locations within the reservation.
AB100-engrossed,548,324 2. An amount calculated by multiplying the number of resident and
25nonresident sports licenses issued during the preceding year by issuing agents other

1than the band at locations within the reservation by the amount of the fee for an
2annual fishing license, including the portion of the issuing fee for an annual fishing
3license that the department receives.
AB100-engrossed,548,7 4(5) Applicability. This section does not apply unless the department and the
5band have in effect a written agreement, approved by the joint committee on finance,
6under which the band agrees to comply with subs. (2) and (3) and that contains all
7of the following terms:

17license is issued to the person subject to s. 29.09 by the department or by a county

6shall issue a nonresident 4-day fishing license, subject to s. 29.09, to any nonresident
7who applies for this license.
AB100-engrossed, s. 1051 8Section 1051. 29.14 (5) of the statutes is amended to read:
AB100-engrossed,549,129 29.14 (5) Nonresident annual family fishing license. The department or a
10county clerk
shall issue a nonresident annual family fishing license, subject to s.
1129.09, to any nonresident who applies for this license. This license entitles the
12husband, wife and any minor children to fish under this license.
AB100-engrossed, s. 1053 13Section 1053. 29.14 (6) of the statutes is amended to read:
AB100-engrossed,549,1714 29.14 (6) Nonresident 15-day family license. The department or a county clerk
15shall issue a nonresident 15-day family fishing license, subject to s. 29.09, to any
16nonresident who applies for this license. This license entitles the husband, wife and
17any minor children to fish under this license.
AB100-engrossed, s. 1055 18Section 1055. 29.14 (7) (a) of the statutes is amended to read:

20nonresident 2-day sports fishing license, subject to s. 29.09, to any nonresident who
21applies for this license.
AB100-engrossed, s. 1057 22Section 1057. 29.14 (7) (c) of the statutes is amended to read:
AB100-engrossed,550,223 29.14 (7) (c) Use of fees. The department shall deposit receipts from the sale
24of nonresident 2-day sports fishing licenses under this subsection in the

1conservation fund. The department shall credit 50% of these receipts to the
2appropriation under s. 20.370 (1) (ku) (4) (ku).
AB100-engrossed, s. 1058 3Section 1058. 29.145 (1) (a) of the statutes is amended to read:
AB100-engrossed,550,104 29.145 (1) (a) Requirement. Except as provided under pars. (b) and (c) and ss.
529.155 (1g) and (1h) and 29.156 and except as specifically provided otherwise by
6another section of this chapter, no resident may fish in the waters of this state unless
7a valid resident fishing license is issued to the person subject to s. 29.09 by the
8department or by a county clerk or unless the person is issued a valid license, permit
9or card
approval which authorizes fishing or entitles the holder to the rights and
10privileges of a fishing license.
AB100-engrossed, s. 1059d 11Section 1059d. 29.145 (1) (c) of the statutes is amended to read:
AB100-engrossed,550,1412 29.145 (1) (c) Exception; residents using nets for nongame fish. No fishing
13license is required for any resident to set, place or use any landing net, dip net,
14minnow seine or minnow dip net in order to fish for fish other than game fish.
AB100-engrossed, s. 1061 15Section 1061. 29.145 (2) (a) of the statutes is amended to read:
AB100-engrossed,550,1816 29.145 (2) (a) A resident annual fishing license shall be issued subject to s.
1729.09 by the department or by a county clerk to a resident of the state applying for

212-day sports fishing license, subject to s. 29.09, to any resident who applies for this

AB100-engrossed,551,224 29.145 (3) (c) Use of fees. The department shall deposit receipts from the sale
25of resident 2-day sports fishing licenses under this subsection in the conservation

1fund. The department shall credit 50% of these receipts to the appropriation under
2s. 20.370 (1) (ku) (4) (ku).
AB100-engrossed, s. 1066 3Section 1066. 29.146 of the statutes is amended to read:
AB100-engrossed,551,7 429.146 Husband and wife fishing licenses. A combined husband and wife
5resident fishing license shall be issued subject to s. 29.09 by the department or a
6county clerk
to residents applying for this license. This license confers upon both
7husband and wife the privileges of resident fishing licenses issued under s. 29.145.
AB100-engrossed, s. 1068 8Section 1068. 29.147 (1) of the statutes is amended to read:
AB100-engrossed,551,139 29.147 (1) A resident sports license shall be issued subject to s. 29.09 by the
10department or by a county clerk to any resident who is over the age of 12 years, a U.S.
11citizen, and who applies for this license and pays the minimum fee. A nonresident
12sports license shall be issued subject to s. 29.09 by the department or by a county
13clerk
to any person who is not a resident and who meets these requirements.
AB100-engrossed, s. 1071 14Section 1071. 29.1475 (3) of the statutes is amended to read:
AB100-engrossed,551,2315 29.1475 (3) Authorization; admission to state parks and related areas. A
16conservation patron license permits any person may operate a vehicle, except a
17motor bus, as defined in s. 340.01 (31), having a conservation patron license holder
18as an occupant to enter
in any vehicle admission area under s. 27.01 (7) without
19having an admission sticker receipt affixed to it the vehicle or otherwise displayed
20and without paying a fee if the vehicle has as an occupant a conservation patron
21license holder who can present the license upon demand in the vehicle admission
22area
. The conservation patron license permits the license holder to enter Heritage
23Hill state park or a state trail without paying an admission fee.
