AB100, s. 4290 Section 4290. 440.08 (4) (b) of the statutes is repealed and recreated to read:

AB100,1684,21 440.08 (4) (b) Applicability. This subsection does not apply to a denial of credential renewal under s. 440.12 (3) or (4).

AB100, s. 4291 Section 4291. 440.12 of the statutes is created to read:

AB100,1684,24 440.12 Tax delinquency and delinquency in support payments. (1) In this section:

AB100,1685,2 (a) "Credentialing board" means an examining board or affiliated credentialing board attached to the department or an examining board.

AB100,1685,3 (b) "Liable for delinquent taxes" has the meaning given in s. 73.0301 (1) (c).

AB100,1685,6 (c) "Memorandum of understanding" means a memorandum of understanding entered into by the department of regulation and licensing and the department of industry, labor and job development under s. 49.857.

AB100,1685,7 (d) "Support" has the meaning given in s. 49.857 (1) (e).

AB100,1685,11 (2) The department shall notify a credentialing board whether or not an applicant for a license, or holder of a license, granted by the credentialing board is certified as liable for delinquent taxes by the department of revenue under s. 73.0301.

AB100,1685,14 (3) Notwithstanding any other provision of chs. 440 to 480 relating to issuance of an initial credential or credential renewal, as provided in the memorandum of understanding:

AB100,1685,18 (a) With respect to a credential granted by the department, the department shall restrict, limit or suspend a credential or deny an application for an initial credential or for reinstatement of an inactive license under s. 452.12 (6) (e) if the credential holder or applicant is delinquent in paying support.

AB100,1685,20 (b) With respect to credential renewal, the department shall deny an application for renewal if the applicant is delinquent in paying support.

AB100,1685,24 (c) With respect to a credential granted by a credentialing board, a credentialing board shall restrict, limit or suspend a credential held by a person or deny an application for an initial credential when directed to do so by the department.

AB100,1686,8 (4) Notwithstanding any other provision of chs. 440 to 480 relating to issuance or renewal of a credential, the department or a credentialing board shall deny an application for an initial credential, credential renewal or reinstatement of a license under s. 452.12 (6) (e) or revoke a credential if the department of revenue certifies under s. 73.0301 that the applicant or credential holder is liable for delinquent taxes or if the department of regulation and licensing notifies the applicable credentialing board under sub. (2) that the applicant or credential holder has been certified by the department of revenue as liable for delinquent taxes.

AB100, s. 4292 Section 4292. 440.26 (2) (b) 1. of the statutes, as affected by 1995 Wisconsin Act 461, is renumbered 440.26 (2) (b).

AB100, s. 4293 Section 4293. 440.26 (2) (b) 2. of the statutes, as created by 1995 Wisconsin Act 461, is repealed.

AB100, s. 4294 Section 4294. 440.26 (3) of the statutes, as affected by 1995 Wisconsin Act 461, is amended to read:

AB100,1687,3 440.26 (3) Issuance of licenses; fees. Upon receipt and examination of an application executed under sub. (2), and after any investigation that it considers necessary, the department shall, if it determines that the applicant is qualified, grant the proper license upon payment of the fee specified in s. 440.05 (1) and the costs, including the costs of record searches, incurred by the department in obtaining information related to the eligibility and qualifications of the applicant. No license shall be issued for a longer period than 2 years, and the license of a private detective shall expire on the renewal date of the license of the private detective agency, even if the license of the private detective has not been in effect for a full 2 years. Renewals of the original licenses issued under this section shall be issued in accordance with renewal forms prescribed by the department and shall be accompanied by the fees specified in s. 440.08. The department may not renew a license unless the applicant provides evidence that the applicant has in force at the time of renewal the bond or liability policy specified in this section.

AB100, s. 4295 Section 4295. 440.26 (5) (b) of the statutes, as affected by 1995 Wisconsin Act 461, is amended to read:

AB100,1687,11 440.26 (5) (b) The license requirements of this section do not apply to any person employed directly or indirectly by the state or by a municipality local governmental unit, as defined in s. 345.05 (1) (c) (bg), or to any employe of a railroad company under s. 192.47, or to any employe of a commercial establishment, while the person is acting within the scope of his or her employment and whether or not he or she is on the employer's premises.

AB100, s. 4296 Section 4296. 440.26 (5m) (a) 1. of the statutes, as created by 1995 Wisconsin Act 461, is amended to read:

AB100,1687,21 440.26 (5m) (a) 1. The individual submits an application for a private security permit to the department on a form provided by the department. The department may require that an individual provide any information which the department determines is reasonably necessary to determine whether the individual meets the requirements of this section and rules promulgated under this section or to establish the truth of the facts set forth in the application. The department may also require under this subdivision that an applicant complete forms provided by the department of justice and the federal bureau of investigation.
