AB133-ASA1,993,1010 2m. A Christmas tree grower licensed under sub. (3g).
AB133-ASA1,993,1211 3. A source outside this state that the department recognizes under sub. (10)
12as an officially inspected source.
AB133-ASA1,993,1313 (j) "Sell" means to transfer ownership, for consideration.
AB133-ASA1,993,17 14(2) Nursery dealer; annual license. (a) License required. Except as provided
15in par. (f), no person may operate as a nursery dealer without an annual license from
16the department. A nursery dealer license expires on February 20. A nursery dealer
17license may not be transferred to another person.
AB133-ASA1,993,2018 (b) Applying for a license. A person applying for a nursery dealer license under
19par. (a) shall apply on a form provided by the department. An applicant shall provide
20all of the following to the department:
AB133-ASA1,993,2221 1. The applicant's legal name and address and any other name under which the
22applicant does business.
AB133-ASA1,993,2423 2. The address of each location at which the applicant proposes to hold nursery
24stock for sale.
AB133-ASA1,993,2525 3. The license fee required under par. (c).
AB133-ASA1,994,1
14. The surcharge required under par. (d), if any.
AB133-ASA1,994,32 5. Other information reasonably required by the department for licensing
3purposes.
AB133-ASA1,994,54 (c) License fee. A nursery dealer shall pay the following annual license fee,
5based on annual purchases calculated according to par. (e):
AB133-ASA1,994,76 1. If the nursery dealer buys no more than $5,000 worth of nursery stock for
7resale, $30.
AB133-ASA1,994,98 2. If the nursery dealer buys more than $5,000 but not more than $20,000 worth
9of nursery stock for resale, $50.
AB133-ASA1,994,1110 3. If the nursery dealer buys more than $20,000 but not more than $100,000
11worth of nursery stock for resale, $100.
AB133-ASA1,994,1312 4. If the nursery dealer buys more than $100,000 but not more than $200,000
13worth of nursery stock for resale, $150.
AB133-ASA1,994,1514 5. If the nursery dealer buys more than $200,000 but not more than $500,000
15worth of nursery stock for resale, $200.
AB133-ASA1,994,1716 6. If the nursery dealer buys more than $500,000 but not more than $2,000,000
17worth of nursery stock for resale, $300.
AB133-ASA1,994,1918 7. If the nursery dealer buys more than $2,000,000 worth of nursery stock for
19resale, $400.
AB133-ASA1,995,220 (d) Surcharge for operating without a license. In addition to the fee required
21under par. (c), an applicant for a nursery dealer license shall pay a surcharge equal
22to the amount of that fee if the department determines that, within 365 days before
23submitting the application, the applicant operated as a nursery dealer without a
24license in violation of par. (a). Payment of the surcharge does not relieve the

1applicant of any other penalty or liability that may result from the violation, but does
2not constitute evidence of a violation of par. (a).
AB133-ASA1,995,83 (e) Calculating annual purchases. The amount of an applicant's license fee
4under par. (c) for a license year shall be based on the applicant's purchases of nursery
5stock during the applicant's preceding fiscal year, except that if the applicant made
6no purchases of nursery stock during the preceding fiscal year the fee shall be based
7on the applicant's good faith prediction of purchases during the license year for which
8the applicant is applying.
AB133-ASA1,995,99 (f) Exemptions. Paragraph (a) does not apply to any of the following:
AB133-ASA1,995,1110 1. A person whose only sales of nursery stock are retail sales totaling less than
11$250 annually.
AB133-ASA1,995,1312 2. A person selling or offering to sell nursery stock for the benefit of a nonprofit
13organization, for a period of not more than 7 consecutive days.
AB133-ASA1,995,17 14(3) Nursery grower; annual license. (a) License required. Except as provided
15in par. (f), no person may operate as a nursery grower without an annual license from
16the department. A nursery grower license expires on February 20. A nursery grower
17license may not be transferred to another person.
AB133-ASA1,995,2018 (b) Applying for a license. A person applying for a nursery grower license under
19par. (a) shall apply on a form provided by the department. An applicant shall provide
20all of the following to the department:

24nursery, grows evergreen trees for eventual sale as Christmas trees or holds nursery

13. The license fee required under par. (c).
AB133-ASA1,996,22 4. The surcharge required under (d), if any.
AB133-ASA1,996,43 5. Other information reasonably required by the department for licensing
4purposes.
AB133-ASA1,996,65 (c) License fee. A nursery grower shall pay the following annual license fee,
6based on annual sales calculated according to par. (e):
AB133-ASA1,996,87 1. If the nursery grower annually sells no more than $5,000 worth of nursery
8stock and Christmas trees, $55.
AB133-ASA1,996,109 2. If the nursery grower annually sells more than $5,000 but not more than
10$20,000 worth of nursery stock and Christmas trees, $100.
AB133-ASA1,996,1211 3. If the nursery grower annually sells more than $20,000 but not more than
12$100,000 worth of nursery stock and Christmas trees, $200.
AB133-ASA1,996,1413 4. If the nursery grower annually sells more than $100,000 but not more than
14$200,000 worth of nursery stock and Christmas trees, $400.
AB133-ASA1,996,1615 5. If the nursery grower annually sells more than $200,000 but not more than
16$500,000 worth of nursery stock and Christmas trees, $600.
AB133-ASA1,996,1817 6. If the nursery grower annually sells more than $500,000 but not more than
18$2,000,000 worth of nursery stock and Christmas trees, $1,200.
AB133-ASA1,996,2019 7. If the nursery grower annually sells more than $2,000,000 worth of nursery
20stock and Christmas trees, $2,400.
AB133-ASA1,997,221 (d) Surcharge for operating without a license. In addition to the fee required

16annual license from the department. A Christmas tree grower license expires on

20license under par. (a) shall apply on a form provided by the department. An applicant

AB133-ASA1,998,87 (c) License fee. A Christmas tree grower shall pay the following annual license
8fee, based on annual sales calculated according to par. (d):

10Christmas trees and nursery stock, $20.
AB133-ASA1,998,1211 2. If the Christmas tree grower annually sells more than $5,000 but not more
12than $20,000 worth of Christmas trees and nursery stock, $55.
AB133-ASA1,998,1413 3. If the Christmas tree grower annually sells more than $20,000 but not more
14than $100,000 worth of Christmas trees and nursery stock, $90.
AB133-ASA1,998,1615 4. If the Christmas tree grower annually sells more than $100,000 but not more
16than $200,000 worth of Christmas trees and nursery stock, $150.
AB133-ASA1,998,1817 5. If the Christmas tree grower annually sells more than $200,000 but not more
18than $500,000 worth of Christmas trees and nursery stock, $250.
AB133-ASA1,998,2019 6. If the Christmas tree grower annually sells more than $500,000 but not more
20than $2,000,000 worth of Christmas trees and nursery stock, $450.
AB133-ASA1,998,2221 7. If the Christmas tree grower annually sells more than $2,000,000 worth of
22Christmas trees and nursery stock, $900.
AB133-ASA1,999,323 (d) Calculating annual sales. The amount of an applicant's license fee under
24par. (c) for a license year shall be based on the applicant's sales of Christmas trees
25and nursery stock during the applicant's preceding fiscal year, except that if the

1applicant made no sales during the preceding fiscal year the fee shall be based on the
2applicant's good faith prediction of sales during the license year for which the
3applicant is applying.
AB133-ASA1,999,64 (e) Exemption. Paragraph (a) does not apply to a Christmas tree grower whose
5only sales of Christmas trees and nursery stock are retail sales totalling less than
6$250 annually.
AB133-ASA1,999,10 7(3m) Notice of new locations. (a) The holder of a nursery dealer license shall
8notify the department in writing before adding, during a license year, any new
9location at which the license holder will hold nursery stock for sale. The license
10holder shall specify the address of the new location in the notice.
AB133-ASA1,999,1511 (b) The holder of a nursery grower or Christmas tree grower license shall notify
12the department in writing before adding, during the license year, any new location
13at which the license holder will operate a nursery, grow evergreen trees for eventual
14sale as Christmas trees or hold Christmas trees or nursery stock for sale. The license
15holder shall specify the address of the new location in the notice.
AB133-ASA1,999,19 16(4) Nursery growers and dealers; records. (a) Nursery dealers; records of
17nursery stock received.
A nursery dealer shall keep a record of every shipment of
18nursery stock received by the nursery dealer. The nursery dealer shall include all
19of the following in the record:
AB133-ASA1,999,2120 1. A description of the types of nursery stock, and the quantity of nursery stock
21of each type, included in the shipment.
AB133-ASA1,999,2322 2. The name and address of the source from which the nursery dealer received
23the shipment.
AB133-ASA1,999,2524 (b) Nursery growers and dealers; records of shipments to other nursery growers
25and dealers.
Each nursery grower and nursery dealer shall record every shipment

1of nursery stock that the nursery grower or nursery dealer sells or distributes to
2another nursery grower or nursery dealer. The nursery grower or nursery dealer
3shall include all of the following in the record:
AB133-ASA1,1000,54 1. A description of the types of nursery stock, and the quantity of nursery stock
5of each type, included in the shipment.
AB133-ASA1,1000,76 2. The name and address of the nursery grower or nursery dealer receiving the
7shipment.
AB133-ASA1,1000,118 (c) Records retained and made available. A nursery grower or nursery dealer
9who is required to keep records under par. (a) or (b) shall retain those records for at
10least 3 years and shall make those records available to the department for inspection
11and copying upon request.
AB133-ASA1,1000,16 12(5) Labeling nursery stock. (a) Nursery stock shipped to grower or dealer. No
13person may sell or distribute any shipment of nursery stock to a nursery grower or
14nursery dealer, and no nursery grower or nursery dealer may accept a shipment of
15nursery stock, unless the nursery stock was grown by a Christmas tree grower or
16unless that shipment is labeled with all of the following:
AB133-ASA1,1000,1817 1. The name and address of the person selling or distributing the shipment to
18the nursery grower or nursery dealer.
AB133-ASA1,1000,2019 2. A certification, by the person under subd. 1., that all of the nursery stock
20included in the shipment is from officially inspected sources.
AB133-ASA1,1000,2421 (b) Growers and dealers to report unlabeled shipments. Whenever any person
22tenders to a nursery grower or nursery dealer any shipment of nursery stock that is
23not fully labeled according to par. (a), the nursery grower or nursery dealer shall
24promptly report that unlabeled shipment to the department.

1(c) Nursery stock sold at retail. A person selling nursery stock at retail shall
2ensure that the nursery stock is labeled with the common or botanical name of the
3nursery stock.
AB133-ASA1,1001,7 4(6) Care of nursery stock. (a) Adequate facilities. A nursery grower or
5nursery dealer shall maintain facilities that are reasonably adequate for the care and
6keeping of nursery stock held for sale, so that the nursery grower or nursery dealer
7can keep the nursery stock in healthy condition pending sale.
AB133-ASA1,1001,118 (b) Reasonable examinations. Nursery growers and nursery dealers shall make
9reasonable examinations of nursery stock held for sale to determine whether that
10nursery stock is capable of reasonable growth, is infested with injurious pests or is
11infected with disease.
AB133-ASA1,1001,13 12(7) Prohibitions. (a) Nursery dealers. No nursery dealer may do any of the
13following:
AB133-ASA1,1001,1514 1. Obtain, hold, sell, offer to sell or distribute nursery stock from any source
15other than an officially inspected source.
AB133-ASA1,1001,1616 2. Misrepresent that the nursery dealer is a nursery grower.
AB133-ASA1,1001,1817 (b) Nursery growers and dealers. No nursery grower or nursery dealer may do
18any of the following:
AB133-ASA1,1001,2219 1. Sell, offer to sell or distribute any nursery stock that the nursery grower or
20nursery dealer knows, or has reason to know, is infested with plant pests or infected
21with plant diseases that may be spread by the sale or distribution of that nursery
22stock.
AB133-ASA1,1001,2423 2. Sell, offer to sell or distribute any nursery stock that the nursery grower or
24nursery dealer knows, or has reason to know, will not survive or grow.
AB133-ASA1,1002,3
13. Misrepresent the name, origin, grade, variety, quality or hardiness of any
2nursery stock offered for sale or make any other false or misleading representation
3in the advertising or sale of nursery stock.
AB133-ASA1,1002,64 4. Conceal nursery stock to avoid inspection by the department, falsify any
5record required under this section or make any false or misleading statement to the
6department.
AB133-ASA1,1002,11 7(8) Department inspection. The department may inspect nurseries and
8premises at which nursery stock is held for sale or distribution. The department may
9inspect premises at which Christmas tree growers grow nursery stock, premises at
10which evergreen trees are grown for eventual sale as Christmas trees and premises
11at which Christmas trees are held for sale or distribution.
AB133-ASA1,1002,14 12(9) Department orders. (a) Holding orders and remedial orders. An
13authorized employe or agent of the department may, by written notice, order a
14nursery grower or nursery dealer to do any of the following:
