(2m) (gm) Notwithstanding s. 349.02, a law enforcement officer may
4not stop or inspect a vehicle solely to determine compliance with this subsection or
5sub. (1) or (2) or a local ordinance in conformity with this subsection, sub. (1) or (2)
6or rules of the department
, except when a law enforcement officer has probable cause
7to believe that a person under 18 years of age is not properly restrained. This
8paragraph does not limit the authority of a law enforcement officer to issue a citation
9for a violation of this subsection or sub. (1) or (2) or a local ordinance in conformity
10with this subsection, sub. (1) or (2) or rules of the department observed in the course
11of a stop or inspection made for other purposes, except that a law enforcement officer
12may not take a person into physical custody solely for a violation of this subsection
1or sub. (1) or (2) or a local ordinance in conformity with this subsection, sub. (1) or
2(2) or rules of the department.".
