11(a) Plan. The legislative fiscal bureau shall, no later than February 1, 2002,
12submit to the cochairpersons of the joint committee on finance a plan to take effect
13on July 1, 2002, for transferring within the department of fish, wildlife, parks, and
14forestry and to the department of environmental management funds appropriated
15under section 20.370 of the statutes for fiscal year 2002-03 and for allocating the
16reduction under
Section 9159 (1) (a) for the department of natural resources for
17fiscal year 2002-03 between the departments. The legislative fiscal bureau shall
18formulate the plan in accordance with the appropriation structure created by this act
19and with the following table, adjusted to reflect the amounts actually appropriated
20under the 2001-03 this act:

1(b) Implementation. The joint committee on finance may implement the plan
2under paragraph (a) as submitted by the legislative fiscal bureau or may modify the

4(8nn) Appointment of boards and secretaries.

5(a) Early appointment. Notwithstanding the effective dates of the treatments
6of sections 15.33 and 15.34 of the statutes by this act, the governor may nominate and
7with the advice and consent of the senate appoint members of the environmental
8management board and of the fish, wildlife, parks, and forestry board beginning on
9January 1, 2002. The board members appointed under this paragraph may advise
10the secretary of natural resources, the department of administration, and the joint
11committee on finance concerning the issues under subsections (1) and (2).
12Notwithstanding the effective date of the treatment of section 15.05 (1) (b), (c), and
13(e) of the statutes by this act, before July 1, 2002, the members of the environmental
14management board appointed under this paragraph may nominate and with the
15approval of the governor appoint the secretary of environmental management to
16take office on July 1, 2002, and the members of the fish, wildlife, parks, and forestry
17board appointed under this paragraph may nominate and with the approval of the
18governor appoint the secretary of fish, wildlife, parks, and forestry to take office on
19July 1, 2002.

17funds for its activities authorized under subchapter VI of chapter 33 of the statutes
18and for providing matching funding for any grants that the commission may be able
19to obtain.".

(8q) Lake management grant for Fish Lake. From the appropriation under
22section 20.370 (6) (ar) of the statutes, the department of natural resources during
23fiscal year 2001-02 shall provide a lake management grant of $200,000 to Dane

1in Dane County and Crystal Lake located in both Dane County and Columbia
2County. The 75% limitation under section 281.69 (2) (a) of the statutes does not apply
3to this grant.".

8the initial members appointed under section 15.377 (2) (i) of the statutes, as affected
9by this act, the initial member appointed under section 15.377 (2) (b) of the statutes,
10as affected by this act, and the initial member appointed under section 15.377 (2) (c)
11of the statutes, as affected by this act, shall serve for terms expiring on July 1, 2002;
12the initial member appointed under section 15.377 (2) (d), (e) and (f) of the statutes,
13as affected by this act, and one of the initial members appointed under section 15.377
14(2) (i) of the statutes, as affected by this act, shall serve for terms expiring on July

23(10f) Joint legislative council study on special education. The joint council
24is requested to conduct a study of criteria to determine a pupil's need for special
1education services; the extent of the problem of providing special education services
2to violent pupils and recommendations on how to address the problem; the
3availability of alternative regular education programs that might be more
4appropriate for pupils currently enrolled in special education programs; the impact
5of statewide, standardized tests on referrals to special education; current training
6of special education teachers; and whether it is possible to recover a larger
7percentage of medical assistance funds for the provision of special education
8services. If the joint legislative council conducts the study, it shall report its findings,
9conclusions, and recommendations to the legislature in the manner provided under
10section 13.172 (2) of the statutes by June 30, 2003.".

(10k) Joint legislative council study on school financing. The joint
13legislative council is requested to conduct a study of school financing. If the joint
14legislative council conducts the study, it shall report its findings, conclusions, and
15recommendations to the legislature in the manner provided under section 13.172 (2)

(10f) Revenue limits. For the purpose of determining a school district's
19revenue limit in the 2002-03 school year, the department of public instruction shall
20exclude from the base state aid received, and property taxes levied, to pay the cost
21of 4-year-old kindergarten pupils who are not children with a disability, as defined
22in section 115.76 (5) of the statutes.".

(3c) Engineering plans. Notwithstanding section 196.491 (3) (a) 3. a. and b.
2of the statutes, as affected by this act,
a person who has filed an application under
3section 196.491 (3) (a) 1. of the statutes before the effective date of this subsection
4shall, no later than 30 days after the effective date of this subsection, provide the
5department of natural resources with a supplemental engineering plan that includes
6a description of the anticipated effects of the facility on residential wells. No later
7than 60 days after the department of natural resources receives a supplemental plan
8under this subsection, the department shall determine whether the facility will
9reduce the availability of water to a residential well or cause a preventive action limit
10established under section 160.15 of the statutes to be exceeded in water produced by
11a residential well. Notwithstanding section 196.491 (3) of the statutes, the public
12service commission may not issue a certificate of public convenience and necessity
13for a facility if the department of natural resources determines under this subsection
14that the facility will reduce the availability of water to a residential well or cause a
15preventive action limit established under section 160.15 of the statutes to be
16exceeded in water produced by a residential well.".

(1c) Study on promoting economic growth. The department of revenue shall
19study options for restructuring shared revenue to encourage high-growth sectors of
20the economy and the creation of high-quality jobs in this state. The study shall
21include considering using up to 10% of the amount distributed to counties and
22municipalities under section 79.03 of the statutes to match local efforts to encourage
23creation of high-quality jobs in this state; recommending ways to incorporate smart
24growth planning under section 16.965 of the statutes into the shared revenue
1program; and studying the feasibility of allowing towns to maintain their boundaries
2in exchange for shared revenue payments. No later than January 1, 2003, the
3department of revenue shall report the result of its study to the secretary of
4administration.".

(a) Notwithstanding section 79.10 (10) (bm) and (bn) of the statutes, as affected
8by this act, and section 79.10 (10) (bm) 2. of the statutes, as created by this act, a
9person who was eligible for a credit under section 79.10 (9) (bm), 1999 stats., or under
10section 79.10 (10) (bn), 1999 stats., related to the 2000 property tax assessment, but
11who did not receive the credit, may claim the credit by applying to the department
12of revenue in the manner specified under section 79.10 (10) (bm) 2. of the statutes,
13as created by this act, no later than October 1, 2001.

(b) Notwithstanding section 79.10 (10) (bm) and (bn) of the statutes, as affected
15by this act, and section 79.10 (10) (bm) 2. of the statutes, as created by this act, the

17of the statutes, as created by this act, all eligible claims under section 79.10 (9) (bm),
181999 stats., or under section 79.10 (10) (bn), 1999 stats., related to the 1999 property
19tax assessment that the department received no later than October 1, 2001.".

Report on tax incentives. The department of revenue, in cooperation
22with the department of workforce development, shall by January 1, 2002, study and
23report on existing incentives in the income tax code in the form of credits and
24deductions available to employers for providing training to employees, for offering
1transportation and child care benefits to employees, for locating places of
2employment in areas of high unemployment and for employing ex-felons, recipients
3of public assistance, and minorities. The report shall include an analysis of the costs
4and effects of such credits and deductions, an analysis of such benefits offered by
5other states, and recommendations for improvements to the state's tax laws designed
6to help attract, develop, and retain a highly skilled, highly trained workforce while
7maintaining a sound, stable tax base. In developing recommendations, the
8department of revenue shall consult with groups representing the interests of
9employers, employees, taxpayers, and any other groups that the department of
10revenue considers appropriate. The report shall be submitted to the appropriate
11standing committees of the legislature, the joint committee on finance, and the
12governor.".
