1An Act relating to: reconciling conflicts and repelling unintended repeals
2(Revisor's Correction Bill).

This revisor's correction bill is explained in the Notes provided by the revisor
of statutes in the body of the bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 7.41 (4) of the statutes is amended to read:

(4) An No individual exercising the right under sub. (1) may
not view
any
5records to which access by observers is prohibited under s. 7.39 (5). The the
6confidential portion of a registration list maintained under s. 6.36 (4) or a poll list
7maintained under s. 6.79 (6). However, the inspectors shall disclose to such an
8individual, upon request, the existence of
confidential records specified in s. 7.39 (5)
9and the information required to be provided to observers under s. 7.39 (5) such a list,
1the number of electors whose names appear on the list, and the number of those
2electors who have voted at any point in the proceedings. No observer may view the
3certificate-affidavit form of an absent elector who obtains a confidential listing
4under s. 6.47 (2).
Note: 1999 Wis. Act 49 created a class of electors, domestic abuse victims, who can
vote anonymously to avoid detection by stalking abusers.
1999 Wis. Act 49 created
language in s. 7.39 (5) and created s. 7.41 (4), which depends on s. 7.39 (5) for its efficacy,
to prevent persons observing elections from viewing a registration list that identifies
domestic abuse victims who voted anonymously.
1999 Wis. Act 182, without taking Act
49 into account, repealed s. 7.39 in its entirety in the process of removing all references
in ch. 7 to "observers." This bill recreates in s. 7.41 (4) the language added to s. 7.39 (5)
in order to give effect to the treatment of those 2 provisions by Act 49.
