SB366, s. 94 Section 94. 341.53 of the statutes is amended to read:

SB366,33,13 341.53 Expiration of registration; transferability of plates plate. Certificates of registration and registration plates issued to dealers, distributors, manufacturers or transporters shall be issued for the calendar year and are valid only during the calendar year for which issued. Registration plates are A registration plate is transferable from one motor vehicle, trailer or semitrailer to another motor vehicle, trailer or semitrailer and from one recreational vehicle to another.

SB366, s. 95 Section 95. 341.625 (1) of the statutes is amended to read:

SB366,33,17 341.625 (1) Any person who fraudulently procures or uses a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) shall forfeit not less than $200 nor more than $500.

SB366, s. 96 Section 96. 341.63 (3) of the statutes, as affected by 1997 Wisconsin Act 84, is amended to read:

SB366,33,24 341.63 (3) Whenever the registration of a vehicle is suspended under this section or ch. 344, the department may order the owner or person in possession of the registration plates plate to return them it to the department. Any person who fails to return the plates plate when ordered to do so by the department may be required to forfeit not more than $200.

SB366, s. 97 Section 97. 342.05 (5) of the statutes is amended to read:

SB366,34,8 342.05 (5) Unless otherwise authorized by rule of the department, a nonresident owner of a vehicle that is not subject to registration in this state may not apply for a certificate of title under this chapter unless the vehicle is subject to a security interest or except as provided in s. 342.16 (1) (a). Notwithstanding any other provision of this section, a nonresident may purchase a temporary operation plates plate under s. 341.09 (4). Any temporary operation permit or plate issued under s. 341.09 shall not be considered registration of the vehicle for purposes of this subsection.

SB366, s. 98 Section 98. 342.15 (4) (a) of the statutes is amended to read:

SB366,34,16 342.15 (4) (a) If the vehicle being transferred is a motorcycle or an automobile registered under s. 341.27 or a motor home or a motor truck, dual purpose motor home or dual purpose farm truck which has a gross weight of not more than 8,000 pounds or a farm truck which has a gross weight of not more than 12,000 pounds, the owner shall remove the registration plates plate and retain and preserve them the plate for use on any other vehicle of the same type and gross weight which may subsequently be registered in his or her name.

SB366, s. 99 Section 99. 342.15 (4) (b) of the statutes is amended to read:

SB366,34,20 342.15 (4) (b) If the vehicle being transferred is a vehicle registered under s. 341.26 at a special fee and the new owner will not be entitled to register the vehicle at such fee, the transferor shall remove and destroy the plates plate.

SB366, s. 100 Section 100. 342.15 (4) (c) of the statutes is amended to read:

SB366,34,24 342.15 (4) (c) In all other cases the transferor shall permit the plates plate to remain attached to the vehicle being transferred, except that if the vehicle has been junked the transferor shall remove and destroy the plates plate.

SB366, s. 101 Section 101. 342.34 (1) (c) of the statutes is amended to read:

SB366,35,11 342.34 (1) (c) If the vehicle is a motorcycle or an automobile registered under s. 341.27 or a motor home or a motor truck, dual purpose motor home or dual purpose farm truck which has a gross weight of not more than 8,000 pounds or a farm truck which has a gross weight of not more than 12,000 pounds, the owner shall remove the registration plates plate and retain and preserve them the plate for use on any other vehicle of the same type which may subsequently be registered in his or her name. If the vehicle is not a motorcycle or an automobile registered under s. 341.27, or a motor home or a motor truck, dual purpose motor home or dual purpose farm truck which has a gross weight of not more than 8,000 pounds or a farm truck which has a gross weight of not more than 12,000 pounds, he or she shall remove and destroy the plates plate.

SB366, s. 102 Section 102. 342.34 (2) (c) of the statutes is amended to read:

SB366,35,14 342.34 (2) (c) Remove and either retain or destroy the registration plates plate for the vehicle as provided in sub. (1) (c).".

SB366, s. 103 Section 103. 343.51 (1) of the statutes is amended to read:

SB366,36,11 343.51 (1) Any person who qualifies for a registration plates plate of a special design under s. 341.14 (1), (1a), (1m) or (1q) or any other person with a disability that limits or impairs the ability to walk may request from the department a special identification card that will entitle any motor vehicle, other than a motorcycle, parked by, or under the direction of, the person, or a motor vehicle, other than a motorcycle, operated by or on behalf of the organization when used to transport such a person, to parking privileges under s. 346.50 (2), (2a) and (3). The department shall issue the card at a fee to be determined by the department, upon submission by the applicant, if the applicant is an individual rather than an organization, of a statement from a physician licensed to practice medicine in any state, from an advanced practice nurse licensed to practice nursing in any state, from a physician assistant licensed or certified to practice in any state, from a chiropractor licensed to practice chiropractic in any state or from a Christian Science practitioner residing in this state and listed in the Christian Science journal that the person is a person with a disability that limits or impairs the ability to walk. The statement shall state whether the disability is permanent or temporary and, if temporary, the opinion of the physician, advanced practice nurse, physician assistant, chiropractor or practitioner as to the duration of the disability. The department shall issue the card upon application by an organization on a form prescribed by the department if the department believes that the organization meets the requirements under this subsection.

SB366, s. 104 Section 104. 344.45 (1) of the statutes, as affected by 1997 Wisconsin Act 84, is amended to read:

SB366,36,20 344.45 (1) Whenever a person's operating privilege or registration is suspended under this chapter, the department may order the person to surrender to the department his or her operator's license and the registration plate or plates of the vehicle or vehicles for which registration was suspended. If the person fails immediately to return the operator's license or registration plate or plates to the department, the department may direct a traffic officer to take possession thereof and return them to the department.

SB366, s. 105 Section 105. 344.55 (2) of the statutes, as affected by 1997 Wisconsin Act 84, is amended to read:

SB366,37,5 344.55 (2) The department may not issue a registration plates plate for such a vehicle unless there is on file with the department a certificate of insurance showing that the vehicle is insured in compliance with sub. (1). No such policy may be terminated prior to its expiration or canceled for any reason unless a notice thereof is filed with the department at least 30 days prior to the date of termination or cancellation. The department shall suspend the registration of a vehicle on which the insurance policy has been terminated or canceled, effective on the date of termination or cancellation.

SB366, s. 106 Section 106. 346.50 (2) of the statutes is amended to read:

SB366,37,18 346.50 (2) Except as provided in sub. (3m), a motor vehicle bearing a special registration plate issued under s. 341.14 (1) or (1r) (a) to a disabled veteran or on his or her behalf is exempt from any ordinance imposing time limitations on parking in any street or highway zone and parking lot, whether municipally owned or leased, or both municipally owned and leased or a parking place owned or leased, or both owned and leased by a municipal parking utility, with one-half hour or more limitation but otherwise is subject to the laws relating to parking. Where the time limitation on a metered stall is one-half hour or more, no meter payment is required. Parking privileges granted by this subsection are limited to the disabled veteran to whom or on whose behalf the special plates were plate was issued and to qualified operators acting under the disabled veteran's express direction with the disabled veteran present.

SB366, s. 107 Section 107. 346.50 (2a) (intro.) of the statutes is amended to read:

SB366,38,7 346.50 (2a) (intro.) Except as provided in sub. (3m), a motor vehicle bearing a special registration plates plate issued under s. 341.14 (1a), (1e), (1m), (1q) or (1r) (a) or a motor vehicle, other than a motorcycle, upon which a special identification card issued under s. 343.51 is displayed or a motor vehicle registered in another jurisdiction upon which is displayed a registration plate, a card or an emblem issued by the other jurisdiction designating the vehicle as a vehicle used by a physically disabled person is exempt from any ordinance imposing time limitations on parking in any street or highway zone and parking lot, whether municipally owned or leased, or both municipally owned and leased or a parking place owned or leased, or both owned and leased by a municipal parking utility, with one-half hour or more limitation but otherwise is subject to the laws relating to parking. SB366,38,17 346.50 (2a) (c) A person to whom plates were a plate was issued under s. 341.14 (1m) when the disabled person for whom the plates were plate was issued is present.

SB366, s. 111 Section 111. 346.50 (2a) (d) of the statutes is amended to read:

SB366,38,20 346.50 (2a) (d) A person for whom plates were a plate was issued under s. 341.14 (1q).

SB366, s. 112 Section 112. 346.50 (2a) (e) of the statutes is amended to read:

SB366,38,24 346.50 (2a) (e) A qualified operator acting under the express direction of a person for whom plates were a plate was issued under s. 341.14 (1q) when such person is present.

SB366, s. 113 Section 113. 346.50 (2a) (f) of the statutes is amended to read:

SB366,39,2 346.50 (2a) (f) A person for whom plates were a plate was issued under s. 341.14 (1r) (a).

SB366, s. 114 Section 114. 346.50 (2a) (g) of the statutes is amended to read:

SB366,39,6 346.50 (2a) (g) A qualified operator acting under the express direction of a person for whom plates were a plate was issued under s. 341.14 (1r) (a) when the person is present.

SB366, s. 115 Section 115. 346.50 (3) of the statutes is amended to read:

SB366,39,19 346.50 (3) Except as provided in sub. (3m), a vehicle bearing a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a motor vehicle, other than a motorcycle, upon which a special identification card issued under s. 343.51 is displayed or a motor vehicle registered in another jurisdiction upon which is displayed a registration plate, a card or an emblem issued by the other jurisdiction designating the vehicle as a vehicle used by a person with a physical disability is exempt from s. 346.505 (2) (a) or any ordinance in conformity therewith prohibiting parking, stopping or standing upon any portion of a street, highway or parking facility reserved for persons with physical disabilities by official traffic signs indicating the restriction. Stopping, standing and parking privileges granted by this subsection are limited to the persons listed under subs. (2) and (2a) (a) to (m).

SB366, s. 116 Section 116. 346.503 (1) of the statutes is amended to read:

SB366,40,2 346.503 (1) In this section, "motor vehicle used by a physically disabled person" means a motor vehicle bearing a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a motor vehicle, other than a motorcycle, upon which a special identification card issued under s. 343.51 is displayed or a motor vehicle registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.

SB366, s. 117 Section 117. 346.505 (2) (a) of the statutes is amended to read:

SB366,40,13 346.505 (2) (a) Except for a motor vehicle used by a physically disabled person as defined under s. 346.503 (1), no person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a special identification card issued under s. 343.51 or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.

SB366, s. 118 Section 118. 346.505 (2) (b) of the statutes is amended to read:

SB366,40,23 346.505 (2) (b) No person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility so as to obstruct, block or otherwise limit the use of any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a special identification card issued under s. 343.51 or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.

SB366, s. 119 Section 119. 346.505 (2) (c) of the statutes is amended to read:

SB366,41,11 346.505 (2) (c) Notwithstanding par. (b), no person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility that is clearly marked as and intended to be an access aisle to provide entry to and exit from vehicles by persons with physical disabilities and which is immediately adjacent to any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a special identification card issued under s. 343.51 or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a person with a physical disability.

SB366, s. 120 Section 120. 349.13 (1m) of the statutes is amended to read:

SB366,41,25 349.13 (1m) In addition to the requirements under s. 346.503 (1m), the department, with respect to state trunk highways outside of corporate limits and parking facilities under its jurisdiction, and local authorities, with respect to highways under their jurisdiction including state trunk highways or connecting highways within corporate limits and parking facilities within corporate limits, may, by official traffic signs indicating the restriction, prohibit parking, stopping or standing upon any portion of a street, highway or parking facility reserved for any vehicle bearing a special registration plates plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a motor vehicle, other than a motorcycle, upon which a special identification card issued under s. 343.51 is displayed or any vehicle registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.

SB366, s. 121 Section 121. 885.237 (2) of the statutes is amended to read:

SB366,42,7 885.237 (2) Notwithstanding s. 341.04, the fact that an automobile or motor truck having a registered weight of 8,000 pounds or less is located on a highway, as defined in s. 340.01 (22), and is not displaying a valid registration plates plate, a temporary operation plate or other evidence of registration as provided under s. 341.18 (1) is prima facie evidence, for purposes of ch. 341, that the vehicle is an unregistered or improperly registered vehicle.

SB366, s. 122 Section 122 . Nonstatutory provisions.

SB366,42,16 (1) Grants to Brown County and municipalities. From the appropriation under section 20.395 (1) (gs) of the statutes, as created by this act, the department of transportation shall award grants totaling $500,000 in January 2003 to Brown County, the city of Green Bay, and the village of Ashwaubenon to be used to pay costs associated with the CTH "VK"/Lombardi Avenue project in the city of Green Bay in Brown County. Grant proceeds under this subsection shall be distributed in proportion to the percentage of the costs of the project to be borne by each local governmental unit.

SB366, s. 123 Section 123. Appropriation changes.

SB366,42,22 (1) In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of transportation under section 20.395 (5) (cq) of the statutes, as affected by the acts of 2001, the dollar amount is decreased by $878,200 for fiscal year 2002-03 to decrease funding for the issuance of registration plates by the department of transportation.

SB366,43,6 (2) In fiscal year 2002-03, the secretary of administration shall transfer from the transportation fund to the general fund an amount equal to the savings realized in that fiscal year by the department of transportation as a result of issuing a single registration plate for motor vehicles under section 341.12 (1) of the statutes, as affected by this act, instead of 2 registration plates. The amount of the transfer under this subsection shall be reduced by the sum of $500,000 and, as determined by the secretary of administration, the amount of additional costs incurred by the department of transportation to implement section 110.08 (5) of the statutes, as created by this act.

SB366, s. 124 Section 124. Initial applicability.

SB366,43,9 (1) This act first applies to registration plates issued by the department of transportation on the effective date of this subsection.

SB366, s. 125 Section 125. Effective dates. This act takes effect on the first day of the 3rd month beginning after publication, except as follows:

SB366,43,13 (1) The repeal of section 20.395 (1) (gs) of the statutes takes effect on July 1, 2003.
