2003 WISCONSIN ACT 239
An Act to renumber and amend 169.09 (2); to amend 169.20 (2) (b) (intro.), 169.20 (4), 169.21 (2) (b) and 169.21 (3); and to create 169.09 (2) (a) 1., 169.09 (2) (a) 2., 169.09 (2), 169.20 (2) (b) 4., 169.20 (2) (b) 5. and 169.20 (2) (b) 6. of the statutes; relating to: the types of captive animals that may be used in training hound dogs.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
239,1c Section 1c. 169.09 (2) of the statutes is renumbered 169.09 (2) (a) (intro.) and amended to read:
169.09 (2) (a) (intro.) No person may sell or offer to sell or purchase or offer to purchase the opportunity to hunt any wild animal that is or has been captive except as authorized under a bird hunting preserve license. one of the following:
239,1e Section 1e. 169.09 (2) (a) 1. of the statutes is created to read:
169.09 (2) (a) 1. A bird hunting preserve license.
239,1g Section 1g. 169.09 (2) (a) 2. of the statutes is created to read:
169.09 (2) (a) 2. A dog training license, if the hunting does not involve the release of a captive wild animal into the wild and does not include shooting, shooting at, intentional killing, or attempting to kill any wild animal.
239,1j Section 1j. 169.09 (2) of the statutes is created to read:
169.09 (2) (b) This subsection does not apply to any of the following:
1. Fees paid to enter into an organized competitive field trial event involving sporting dog breeds that is sanctioned, licensed, or recognized by a local, state, regional, or national dog organization and authorized under a valid bird dog trial license or hound dog trial license.
2. Membership fees paid to join a dog club.
239,1m Section 1m. 169.20 (2) (b) (intro.) of the statutes is amended to read:
169.20 (2) (b) (intro.) A hound dog training license authorizes the holder of the license to purchase, possess, release into the wild, and hunt any of the following live captive wild animals for the purpose of teaching hound dogs to track game:
239,2 Section 2. 169.20 (2) (b) 4. of the statutes is created to read:
169.20 (2) (b) 4. Live captive fox.
239,3 Section 3. 169.20 (2) (b) 5. of the statutes is created to read:
169.20 (2) (b) 5. Live captive coyote.
239,4 Section 4. 169.20 (2) (b) 6. of the statutes is created to read:
169.20 (2) (b) 6. Live captive bobcat.
239,4m Section 4m. 169.20 (4) of the statutes is amended to read:
169.20 (4) Rules. The department may promulgate rules to establish additional standards, limitations, and requirements for licenses issued under this section. The rules may include standards that provide adequate protection for the wild animals that are authorized under a dog training license. The department shall issue a license to an applicant based on the rules in effect under this subsection on the date of the application and may not delay the issuance of a license pending promulgation of additional, modified, or new rules.
239,5 Section 5. 169.21 (2) (b) of the statutes is amended to read:
169.21 (2) (b) A hound dog trial license authorizes the holder of the license to purchase, possess, release into the wild, and hunt live captive raccoon, live captive rabbit, live captive fox, live captive coyote, live captive bobcat, and live captive bear of the species Ursus americanus for any organized competitive field event that involves sporting dog breeds and that is sanctioned, licensed, or recognized by a local, state, regional, or national dog organization.
239,6m Section 6m. 169.21 (3) of the statutes is amended to read:
169.21 (3) Rules. The department may promulgate rules to establish additional standards, limitations, and requirements for licenses issued under this section. The rules may include standards that provide adequate protection for the wild animals that are authorized under a dog trial license. The department shall issue a license to an applicant based on the rules in effect under this subsection on the date of the application and may not delay the issuance of a license pending promulgation of additional, modified, or new rules.
