9to enter procurement orders via an Internet browser, a device designed to access the
10World Wide Web, a facsimile transmission, a telephone, or another method of
11inputting data electronically into the system.
SB44-SSA1,1023,1312 6. The proposal shall provide for training via the Internet and shall provide for
13on-site, in-person training at all major state facilities.
SB44-SSA1,1023,1714 (d) Status and informational report. No later than July 1, 2004, the
15department shall submit a report to the appropriate standing committees of the
16legislature in the manner provided under section 13.172 (3) of the statutes,
17indicating all of the following:
SB44-SSA1,1023,1818 1. The status of the solicitations under paragraph (b).
SB44-SSA1,1023,2019 2. The current estimated cost for implementing proposals that comply with
20paragraph (b).

22efficiencies achieved through implementation of proposals that comply with
23paragraph (b) and an estimate of any expected cost savings and efficiencies.

14. The feasibility of consolidating all state agency employees performing duties
2primarily related to state agency procurement into the department's bureau of
3procurement.
SB44-SSA1,1024,114 (e) Implementation. During the 2003-05 fiscal biennium, the department shall
5implement any portion of a lowest, acceptable competitive sealed proposal solicited
6under paragraph (b) that may be implemented without statutory changes or
7additional funding. The department shall include, in the program and financial
8information required to be forwarded under section 16.42 (1) of the statutes by
9September 15, 2004, a plan for the implementation, during the 2005-07 fiscal
10biennium, of the remaining portions of the lowest, acceptable competitive sealed
11proposals solicited under paragraph (b). The plan shall include all of the following:

14implement the plan, including statutory changes requiring all state agencies to

SB44-SSA1,1024,2017 3. Within 6 months after implementation of the system described under
18paragraph (b) 3., the deletion of 88.0 authorized FTE positions that perform duties
19primarily related to state agency procurement and that are funded with nonfederal
20moneys.
SB44-SSA1,1025,421 4. The lapse to the general fund from the appropriate appropriation account of
22any state agency in which a position funded from general purpose revenue is
23eliminated under subdivision 3. of an amount equal to the salary and fringe benefits
24budgeted for the position for the balance of each applicable fiscal year; and the
25transfer to the general fund from the appropriate appropriation account of any state

1agency in which a position funded from a source other than general purpose revenue
2or federal revenue is eliminated under subdivision 3. of an amount equal to the salary
3and fringe benefits budgeted for the position for the balance of each applicable fiscal
4year.
SB44-SSA1,1025,12 5(7) Position transfer; employee status. The incumbent employee holding the
6position specified in Section 9159 (8 ) is transferred on July 1, 2003, to the
7department of administration and has all the rights and the same status under
8subchapter V of chapter 111 and chapter 230 of the statutes in the department of
9administration that he or she enjoyed in the department of workforce development
10immediately before the transfer. Notwithstanding section 230.28 (4) of the statutes,
11no employee so transferred who has attained permanent status in class is required
12to serve a probationary period.
SB44-SSA1,1025,13 13(8c) Transfer of waste facility siting board.
SB44-SSA1,1025,17 14(a) Assets and liabilities. On the effective date of this paragraph, the assets and
15liabilities of the department of administration primarily related to the functions of
16the waste facility siting board, as determined by the secretary of administration,
17shall become the assets and liabilities of the department of natural resources.
SB44-SSA1,1025,21 18(b) Tangible personal property. On the effective date of this paragraph, all
19tangible personal property of the department of administration that is primarily
20related to the functions of the waste facility siting board, as determined by the
21secretary of administration, is transferred to the department of natural resources.
SB44-SSA1,1026,3 22(c) Contracts. All contracts entered into by the department of administration
23in effect on the effective date of this paragraph that are primarily related to the
24functions of the waste facility siting board, as determined by the secretary of
25administration, remain in effect and are transferred to the department of natural

1resources. The department of natural resources shall carry out any obligations
2under such a contract until the contract is modified or rescinded by the department
3of natural resources to the extent allowed under the contract.
SB44-SSA1,1026,5 4(8f) Employer contributions for health insurance premiums for state
5employees.
SB44-SSA1,1026,7 6(a) The definitions in section 20.001 of the statutes are applicable in this
7subsection.
SB44-SSA1,1026,12 8(b) The secretary of administration shall determine for each state agency the
9amount that the agency would have been required to expend under section 40.05 (4)
10(ag) 1., 2001 stats., during the period that begins on January 1, 2004, and ends on
11June 30, 2005, and from each appropriation from which the moneys would have been
12expended, other than appropriations of federal revenues.
SB44-SSA1,1026,19 13(c) From each sum certain appropriation of general purpose revenue identified
14in paragraph (b), the secretary of administration shall lapse to the general fund the
15amount specified in paragraph (b) that would otherwise have been expended from
16each of the appropriations. The secretary shall make the lapse on the day on which
17the state agency would have been required to make the expenditure. After the
18secretary makes the lapse, each of the sum certain appropriations is decreased by the
19amount specified in paragraph (b) for that appropriation.
SB44-SSA1,1026,23 20(d) For each sum sufficient appropriation of general purpose revenue identified
21in paragraph (b), the expenditure estimate for the appropriation during the 2003-05
22fiscal biennium is reestimated to subtract the amount specified in paragraph (b) for
23that appropriation.
SB44-SSA1,1027,6 24(e) From each appropriation of program revenues or program revenues-service
25identified in paragraph (b), the secretary of administration shall lapse to the general

12make the expenditure. After the secretary makes the lapse, each of the sum certain
13segregated revenues or segregated revenues — service appropriations is decreased
14by the amount specified in paragraph (b) for that appropriation and the expenditure
15estimate for each of the appropriations that are not sum certain appropriations is
16reestimated to subtract the amount specified in paragraph (b) for that appropriation.
17The secretary shall then transfer the lapsed amounts and an amount equal to the
18amount subtracted from the estimates to the general fund.

3and (bw) and subchapter IX of chapter 40 of the statutes during the 2003-05 fiscal
4biennium had the obligations not been issued, and from each appropriation from
5which the moneys would have been expended.

7in paragraph (b), the secretary of administration shall lapse to the general fund the
8amount specified in paragraph (b ) that would otherwise have been expended from

7paragraph (b), the secretary of administration shall lapse to the underlying fund the
8amount specified in paragraph (b ) that would otherwise have been expended from
9each of the appropriations. The secretary of administration shall make the lapse on
10the day on which the state agency would have been required to make the
11expenditure. After the secretary of administration makes the lapse, each of the sum
12certain segregated revenues or segregated revenues — service appropriations is
13decreased by the amount specified in paragraph (b ) for that appropriation, and the
14expenditure estimate for each of the appropriations that are not sum certain
15appropriations is reestimated to subtract the amount specified in paragraph (b) for
16that appropriation. The secretary of administration shall then transfer the lapsed
17amounts and an amount equal to the amount subtracted from the estimates to the
18general fund.
SB44-SSA1,1029,20 192. From each appropriation of segregated federal revenues, the secretary of
20administration shall determine the amount that is transferred to the general fund.
SB44-SSA1,1029,22 21(9q) Appropriation account lapses and fund transfers resulting from
22Wisconsin retirement system contributions savings.
SB44-SSA1,1029,25 23(a) Definitions. The definitions in section 20.001 of the statutes are applicable
24in this subsection, except that "state agency" does not include the department of
25employee trust funds or the investment board.

1(b) Determination of credit amounts. If obligations are issued under section
216.526 or 16.527 of the statutes, as created by this act, or both, during the 2003-04
3fiscal year, the secretary of administration shall determine for each state agency any
4amount credited by the department of employee trust funds to the state agency's
5appropriations from program revenues, program revenues-service, segregated fund
6revenues, and segregated fund revenues — service during the 2003-04 fiscal year,
7other than amounts described in Section 9101 (9) (b) of this act, that represents an
8overpayment of a liability due to the issuance of the obligations.
SB44-SSA1,1030,99 (c) Lapses and transfers.
SB44-SSA1,1030,1310 1. During the 2003-04 fiscal year, the secretary of administration shall lapse
11from each state agency's appropriations from program revenues and program
12revenues-service to the general fund the amounts calculated by the secretary under
13paragraph (b) for those appropriations.
SB44-SSA1,1030,1914 2. During the 2003-04 fiscal year, the secretary of administration shall lapse
15from each state agency's appropriations from segregated fund revenues and
16segregated fund revenues — service to the appropriate segregated fund the amount
17calculated by the secretary under paragraph (b) for those appropriations. After
18making this lapse, the secretary shall transfer from the appropriate segregated fund
19to the general fund an amount equal to the lapse.
SB44-SSA1,1030,20 20(9x) Attorney positions.
SB44-SSA1,1030,23 21(a) In this subsection, "state agency" means an office, commission, department,
22independent agency, or board in the executive branch of state government, excluding
23the Board of Regents of the University of Wisconsin System.
SB44-SSA1,1031,3 24(b) On January 2, 2004, all attorney positions in all state agencies that are
25vacant on that date are eliminated. If fewer than 31.0 FTE attorney positions in all

1state agencies are vacant on January 2, 2004, there are eliminated the requisite
2number of FTE attorney positions, as identified by the secretary of administration,
3so that a total of 31.0 FTE attorney positions are eliminated.
SB44-SSA1,1031,12 4(c) 1. On January 2, 2004, the secretary of administration shall lapse to the
5general fund from the appropriate appropriation account of any state agency in
6which a position funded from general purpose revenue is eliminated under
7paragraph (b) an amount equal to the salary and fringe benefits budgeted for the
8position for the balance of the 2003-04 fiscal year; and shall transfer to the general
9fund from the appropriate appropriation account of any state agency in which a
10position funded from a source other than general purpose revenue or federal revenue
11is eliminated under paragraph (b) an amount equal to the salary and fringe benefits
12budgeted for the position for the balance of the 2003-04 fiscal year.
SB44-SSA1,1031,21 132. On July 1, 2004, the secretary of administration shall lapse to the general
14fund from the appropriate appropriation account of any state agency in which a
15position funded from general purpose revenue is eliminated under paragraph (b) an
16amount equal to the salary and fringe benefits budgeted for the position for the
172004-05 fiscal year; and shall transfer to the general fund from the appropriate
18appropriation account of any state agency in which a position funded from a source
19other than general purpose revenue or federal revenue is eliminated under
20paragraph (b) an amount equal to the salary and fringe benefits budgeted for the
21position for the 2004-05 fiscal year.
SB44-SSA1,1032,12 22(10) Transitional funding of housing operations. Notwithstanding the
23requirement under section 20.001 (3) (a) of the statutes that annual appropriations
24are expendable only up to the amount shown in the schedule and only for the fiscal
25year for which made, and notwithstanding the requirement under section 20.001 (3)

1(b) of the statutes that biennial appropriations are expendable only up to the total
2amount shown in the schedule for both years and only for the biennium for which
3made, during the period that begins on the effective date of this subsection and ends
4on the 30th day after the effective date of this subsection, the annual and biennial
5appropriations to the department of administration under section 20.505 (7) of the
6statutes provided for the 2002-03 fiscal year shall remain in effect until the 30th day
7after the effective date of this subsection, except that, for the annual appropriations,
8the department of administration may not expend or encumber more than
9one-twelfth of the amounts appropriated for the 2002-03 fiscal year from each such
10appropriation and, for the biennial appropriations, the department of
11administration may not expend or encumber more than one-twelfth of the amounts
12shown in the schedule for the 2002-03 fiscal year from each such appropriation.
SB44-SSA1,1032,13 13(10d) Transfer of educational technology programs.
SB44-SSA1,1032,1814 (a) The authorized FTE positions for the department of administration, funded
15from the appropriation under section 20.505 (4) (hc) of the statutes, as created by this
16act, are increased by 0.5 PR position on the effective date of this subsection for the
17administration of technology for educational achievement programs under
18subchapter IX of chapter 16 of the statutes, as created by this act.
SB44-SSA1,1032,2319 (b) The authorized FTE positions for the department of administration, funded
20from the appropriation under section 20.505 (4) (mp) of the statutes, as affected by
21this act, are increased by 0.5 FED position on the effective date of this subsection for
22the administration of technology for educational achievement programs under
23subchapter IX of chapter 16 of the statutes, as created by this act.
SB44-SSA1,1033,324 (c) The authorized FTE positions for the department of administration, funded
25from the appropriation under section 20.505 (4) (s) of the statutes, as affected by this

1act, are increased by 1.0 SEG position on the effective date of this subsection for the
2administration of technology for educational achievement programs under
3subchapter IX of chapter 16 of the statutes, as created by this act.
SB44-SSA1,1033,12 4(10z) Encumbrance of certain moneys for construction of a veterinary
5diagnostic laboratory.
The secretary of administration, on a continuing basis, shall
6encumber moneys from the appropriation account under section 20.285 (1) (je) of the
7statutes, as affected by this act, to reimburse section 20.866 (1) (u) of the statutes,
8as affected by this act, for the payment of principal and interest costs incurred in
9financing the construction of the veterinary diagnostic laboratory enumerated in
102001 Wisconsin Act 16, section 9107 (1) (m) 1. The secretary of administration shall
11encumber these moneys as soon as practicable after ensuring that the general
12program operations of the veterinary diagnostic laboratory are adequately funded.
SB44-SSA1,1033,13 13(11p) Youth diversion grant reductions.
SB44-SSA1,1033,17 14(a) Notwithstanding the amount specified under section 16.964 (8) (a) of the
15statutes, the office of justice assistance shall reduce the amount of money allocated
16under section 16.964 (8) (a) of the statutes by $21,200 in fiscal year 2003-04 and by
17$1,600 in fiscal year 2004-05.
SB44-SSA1,1033,21 18(b) Notwithstanding the amounts specified under section 16.964 (8) (c) of the
19statutes, the office of justice assistance shall reduce the amount of money allocated
20for each of the 4 contracts specified under section 16.964 (8) (c) of the statutes by
21$6,400 in fiscal year 2003-04 and by $500 in fiscal year 2004-05.
SB44-SSA1,1034,3 22(11q) Review of state office space utilization and consolidation plan. The
23department of administration shall review the occupancy of all state-owned office
24buildings and office space leased by the state and, based upon that review, develop
25a plan for greater centralization of the offices of state agencies or subunits thereof

1into state-owned office buildings and reduction of the amount of office space leased
2by the state. The department of administration shall submit the plan to the
3cochairpersons of the joint committee on finance no later than January 1, 2004.
SB44-SSA1,1034,9 4(12d) Report regarding expenditures relating to gaming compact
5amendments.
No later than September 1, 2004, the department of administration
6shall submit a report to the joint committee on finance regarding the department's
7supplies and services expenditures in fiscal year 2003-04 relating to the expanded
8responsibilities of the office of Indian gaming under the 2003 state-tribal gaming
9compact amendments.
SB44-SSA1,1034,16 10(12p) Application for federal reimbursement for certain election-related
11expenditures.
The department of administration shall ensure that this state does
12not seek reimbursement from the federal government under Title II of P.L. 107-252
13for expenditures made by this state to implement a statewide computerized
14registration system from moneys that were allocated for this purpose by the joint
15committee on finance at its meeting under section 13.10 of the statutes in December
162002.
SB44-SSA1,1034,18 17(13p) Assistant district attorneys; Byrne grant and penalty assessment
18expenditures.
SB44-SSA1,1034,23 19(a) The department of administration shall allocate $165,000 from the
20appropriation account under section 20.505 (6) (kp) of the statutes, as affected by the
21acts of 2003, and $495,000 from the appropriation account under section 20.505 (6)
22(p) of the statutes, as affected by the acts of 2003, in each year of the 2003-05 fiscal
23biennium to fund 11.0 FTE assistant district attorney positions.
SB44-SSA1,1035,2 24(b) From the appropriation account under section 20.505 (6) (kp) of the statutes,
25as affected by the acts of 2003, the department of administration shall allocate the

1following amounts for the following programs in each year of the 2003-05 fiscal

SB44-SSA1,1035,16 11(c) Notwithstanding the amounts in paragraph (b) and section 16.964 (9) of the
12statutes, as affected by the acts of 2003, the department of administration shall
13reduce the total amount of money allocated from the appropriation account under
14section 20.505 (6) (kp) of the statutes, as affected by the acts of 2003, for programs
15under paragraph (b) by $22,300 in each year of the 2003-05 fiscal biennium to fund
16the assistant district attorney positions under paragraph (a).

19during the fiscal year for which an expenditure estimate is submitted under
20paragraph (b), lapse to the general fund the amount of any estimate disapproved
21under paragraph (b) for expenditure of moneys that are appropriated from any
22appropriation, other than a sum sufficient appropriation, made from general
23purpose revenues. Except as provided in paragraph (d), the secretary shall, during
24the fiscal year for which an expenditure estimate is submitted under paragraph (b),
25transfer to the general fund the amount of any estimate disapproved under

1paragraph (b) for the expenditure of moneys that are appropriated from any
2appropriation, other than a sum sufficient appropriation, made from program
3revenues, program revenues-service, segregated fund revenues, or segregated fund
4revenues — service. The secretary shall reestimate to subtract from the expenditure
5estimate published in the acts of 2003 under section 20.005 (3) of the statutes the
6amount of any estimate disapproved under paragraph (b) for expenditure of moneys
7that are appropriated from any sum sufficient appropriation. The secretary shall
8include any reestimate under this paragraph in his or her submission under section
920.004 (2) of the statutes.

11appropriation if the lapse or transfer would violate a condition imposed by the federal
12government on the expenditure of the moneys or if the lapse or transfer would violate
13state law or the federal or state constitution.

15the printing of any publication under paragraph (b), the department submitting the
16estimate shall post the content of the publication that would have been printed on

SB44-SSA1,1038,14 21(3x) Consumer protection reduction plan. On or before November 1, 2003, the
22department of agriculture, trade and consumer protection shall submit a plan to the

1joint committee on finance detailing how the department proposes to implement the
2reduction in positions required by this act relating to the department's consumer
3protection activities. The plan shall identify the titles of all of the positions that the
4department proposes to eliminate and the location of those positions. The plan shall
5also specify how the department plans to reduce costs and shall identify the fringe
6benefits, supplies, and property that the department proposes to reduce or eliminate.
7If the cochairpersons of the committee do not notify the department within 14
8working days after the date of the department's submittal of the plan that the
9committee has scheduled a meeting for the purpose of reviewing the plan, the plan
10may be implemented as proposed by the department. If, within 14 working days after
11the date of the department's submittal, the cochairpersons of the committee notify
12the department that the committee has scheduled a meeting for the purpose of
13reviewing the proposed plan, the plan may be implemented only upon approval of the
14committee.
SB44-SSA1,1038,20 15(3z) Household hazardous waste rules. The department of agriculture, trade
16and consumer protection shall administer the household hazardous waste program

1(2) Programs previously authorized. In addition to the projects and financing
2authority enumerated under subsection (1), the building and financing authority
3enumerated under the previous Authorized State Building Program is continued in
4the 2003-05 fiscal biennium.
SB44-SSA1,1053,9 5(3) Loans. During the 2003-05 fiscal biennium, the building commission may
6make loans from general fund supported borrowing or the building trust fund to state
7agencies, as defined in section 20.001 (1) of the statutes, for projects which are to be
8utilized for programs not funded by general purpose revenue and which are
9authorized under subsection (1).
