(3) Campaign. (a) Every individual filing an income tax return who has
7a tax liability or is entitled to a tax refund may indicate on the return that the
8individual does not wish $5 to be transferred to the Wisconsin election campaign
9fund. If the individuals filing a joint return have a tax liability or are entitled to a
10tax refund, each individual may indicate on the return that the individual does not
11wish $5 to be transferred to the Wisconsin election campaign fund. The amounts
12transferred under this paragraph shall be placed in the general account for the use
13of all eligible candidates for state office unless the individual specifies that his or her
1transferred amount shall be placed in the account of an eligible political party whose
2name is certified to the secretary of revenue under s. 11.50 (14).

(b) The secretary of revenue shall provide a place for indications and
4specifications under par. (a) on the face of the individual income tax return and shall
5provide next to that place a statement that an indication will not affect the amount
6of the individual's tax liability or refund. No later than the 15th day of each month,
7the secretary of revenue shall certify to the elections board, the department of
8administration, and the state treasurer the total number of individuals filing income
9tax returns who had a tax liability or were entitled to a refund during the preceding
10month, less the number of individuals making an indication under par. (a),
11multiplied by $5. If any individual attempts to place any condition or restriction
12upon an indication under par. (a), other than a specification under par. (a), that
13individual is deemed not to have made an indication.".
