(1) (a) Subject to pars. (am),
(ar), (b) and (c), the board may establish for
5different classes of students differing tuition and fees incidental to enrollment in
6educational programs or use of facilities in the system. Except as otherwise provided
7in this section, the board may charge any student who is not exempted by this section
8a nonresident tuition. The board may establish special rates of tuition and fees for
9the extension and summer sessions and such other studies or courses of instruction
10as the board deems advisable.

(1) (ar) 1. Except as provided in subd. 2., in fiscal years 2009-10, 2010-11,
62011-12, and 2012-13, the board may not increase the sum of academic fees and
7nonallocable segregated fees for undergraduate students by more than the
8percentage increase in the U.S. consumer price index for all urban consumers during
9the previous fiscal year, as determined by the legislative fiscal bureau.

2. If a majority of the students enrolled in an institution who vote in a
11referendum approve an increase in nonallocable segregated fees for a specified fiscal
12year, the board may do the following:

a. Increase academic fees for undergraduate students at the institution by no
14more than the percentage increase in the U.S. consumer price index for all urban
15consumers during the previous fiscal year, as determined by the legislative fiscal
16bureau.

b. Increase nonallocable segregated fees for undergraduate students at the
18institution for the fiscal year by the amount approved in the referendum.".
