(a) Beginning with fiscal year 2000-01 and ending with fiscal year 5
2019-20, the department may obligate moneys under the subprogram for land 6
acquisition to acquire land for the purposes specified in s. 23.09 (2) (d) and grants for 7
these purposes under s. 23.096, except as provided under ss. 23.197 (2m), (3m) (b), 8
(7m), and (8) and,
23.198 (1) (a), and 31.385 (2) (e)
(e) 1. In this paragraph:
a. "Department order" means an order or directive issued by the department 2
to maintain, repair, or modify a dam.
b. "High hazard dam" has the meaning given in s. 31.19 (1g) (a).
2. Beginning on July 1, 2010, in addition to financial assistance provided under 5
par. (d), the department shall provide financial assistance for dam safety projects 6
described in subd. 3. from the appropriation account under s. 20.866 (2) (ta) of not 7
more than $19,500,000.
3. Notwithstanding the eligibility requirements for financial assistance under 9
par. (c), the department shall provide financial assistance from the appropriation 10
account under s. 20.866 (2) (ta) for projects to maintain, repair, or modify a dam to 11
increase the safety of the dam, regardless of whether the dam is subject to a 12
department order. The department shall give priority under this paragraph to high 13
hazard dams and dams that are subject to a department order. Notwithstanding the 14
limitations under par. (a) 1. and 3., financial assistance provided under this 15
paragraph is limited to no more than 75 percent of the cost of the project, but not more 16
4. For purposes of s. 23.0917, moneys provided under this paragraph shall be 18
treated as moneys obligated from the land acquisition subprogram under s. 23.0917 19
(3). No moneys may be obligated under this paragraph after June 30, 2013.".
