6facility at Marquette University.
(a) The legislature finds and determines that it
7is vital for economic development in this state to ensure the availability of a sufficient
8number of engineers to meet the needs of businesses and residents of this state. It
9is therefore in the public interest, and it is the public policy of this state, to assist
10private institutions in this state, including Marquette University, in the construction
11of a facility that will be used for engineering education.
AB75-SSA1-SA1,2,1812 (b) The building commission may authorize up to $10,000,000 of general fund
13supported borrowing to aid in the construction of an engineering education facility
14at Marquette University. The state funding commitment for the construction of the
15facility shall be in the form of a construction grant to Marquette University. Before
16approving any state funding commitment for such a facility and before awarding the
17construction grant to Marquette University, the building commission shall
18determine that all of the following conditions have been met:
AB75-SSA1-SA1,2,2319 1. Marquette University has secured additional funding commitments of at
20least $25,000,000 from nonstate revenue sources, the nonstate revenue sources are
21reasonable and available, and the total funding commitments of the state and the
22nonstate sources will permit Marquette University to enter into contracts for the
23construction of the engineering education facility.

12. The engineering facility will not be used for the purpose of devotional
2activities, religious worship, or sectarian instruction.
AB75-SSA1-SA1,3,53 (c) If the building commission authorizes a construction grant to Marquette
4University under par. (b), Marquette University shall provide the state with an
5option to purchase the engineering education facility under the following conditions:
AB75-SSA1-SA1,3,96 1. The option price shall be the appraised fair market value at the time that the
7option is exercised, less a credit recognizing the amount of the state's construction
8grant. The option shall be subject to any mortgage or other security interest of any
9private lenders.
AB75-SSA1-SA1,3,1010 2. The option may be exercised only upon the occurrence of any of the following:
AB75-SSA1-SA1,3,1211 a. Suspension of operation of a program of engineering education at Marquette
12University or any successor organization.
AB75-SSA1-SA1,3,1313 b. Foreclosure of the mortgage by a private lender.
AB75-SSA1-SA1,3,2014 (d) If the state does not exercise the option to purchase the engineering
15education facility, and if the facility is sold to any 3rd party, any agreement to sell the
16facility shall provide that the state has the right to receive an amount equal to the
17construction grant under par. (b) from the net proceeds of any such sale after the
18mortgage has been satisfied and all other secured debts have been paid. This right
19shall be paramount to the right of Marquette University to the proceeds upon such
20sale.".

6council. Members of the 911 council shall undertake their duties in a manner that
7is competitively and technologically neutral to all service providers. The council
8shall adopt guidelines for reimbursement of member expenses under s. 15.09 (6).

10the 911 fund and on administering the 911 grant program and surcharge and
11developing the statewide plan for enhanced 911 service under s. 256.35 (3g), on any
12related rules, and on any other matters assigned to the council by the commission.".
