"(b) Additional information requested. 1.
If the department determines that 4
the application is incomplete, the department shall notify the applicant in writing
5and may make only one request for additional information during the 30-day period
6specified in par. (a). Within 10 days after receiving the additional information from
7the applicant, the department shall notify the applicant in writing as to whether the
8application is complete. The date on which the 2nd notice under this paragraph is
9sent shall be set as the date of closure for purposes of sub. (3) (a), except as provided
10in subd. 3.
30.208 (2) (b) 2. and 3. of the statutes are created to read:
(b) 2. If the department notifies the applicant under subd. 1. that the 2
application is incomplete, the notification may contain a final request for additional 3
information. Within 5 days after receiving this additional information from the 4
applicant, the department shall send the applicant a final notice in writing as to 5
whether the application is complete.
3. The date on which the final notice under subd. 2. is sent shall be set as the 7
date of closure for purposes of sub. (3) (a).
(bn) Supplemental information.
The department may request 10
additional information from the applicant to supplement the application after the 11
applicable date of closure as determined under par. (a) or (b) 1. or 3., but the 12
department may not request items of information that are outside the scope of the 13
original request unless the applicant and the department both agree. A request for 14
any such additional information may not affect the applicable date of closure.".
(d) Failure to meet time limits.
If the department fails to meet the 18
30-day limit under par. (a), the 10-day limit under par. (b) 1., or the 5-day limit 19
under par. (b) 2., the application shall be considered to have a date of closure that is 20
the last day of that 30-day, 10-day, or 5-day period for purposes of sub. (3) (a).".
