ASSEMBLY AMENDMENT 11, TO ASSEMBLY BILL 4

AB4-AA11,1,1 At the locations indicated, amend the bill as follows:

AB4-AA11,1,4 1. Page 1, line 2: after "program" insert ", funding for various programs of the Department of Transportation, transferring money from the general fund to the transportation fund, and making an appropriation".

AB4-AA11,1,5 2. Page 1, line 3: before that line insert:

AB4-AA11,1,6 " Section 1c. 20.395 (9) (cs) of the statutes is created to read:

AB4-AA11,1,13 20.395 (9) (cs) Supplemental funding for various programs, state funds. A sum sufficient, not to exceed $25,000,000, in fiscal year 2012-13 for improvement of existing state trunk and connecting highways and the construction and rehabilitation of the national system of interstate and defense highways and bridges and related appurtenances, for freight rail and mass transit assistance, and for airport improvements. No moneys may be encumbered from this appropriation account after June 30, 2013.

AB4-AA11, s. 1d Section 1d. 84.013 (2) (b) of the statutes is amended to read:

AB4-AA11,2,7 84.013 (2) (b) Except as provided in ss. 84.014, 84.03 (3), and 84.555, and subject to s. 86.255, reconditioning, reconstruction and resurfacing of highways shall be funded from the appropriations under ss. 20.395 (3) (cq) to (cx) and (9) (cs) and 20.866 (2) (uur) and (uut), except that such activities may not be funded from the appropriation under s. 20.395 (9) (cs) unless the department of administration receives the notice under s. 560.703 (1) (am).

AB4-AA11, s. 1e Section 1e. 85.08 (6) of the statutes is created to read:

AB4-AA11,2,12 85.08 (6) Additional funding. The department may provide additional funding for any purpose specified in this section from the appropriation under s. 20.395 (9) (cs) if the department of administration receives the notice under s. 560.703 (1) (am).

AB4-AA11, s. 1f Section 1f. 85.20 (9) of the statutes is created to read:

AB4-AA11,2,17 85.20 (9) Additional funding. The department may provide additional funding for any purpose specified in this section from the appropriation under s. 20.395 (9) (cs) if the department of administration receives the notice under s. 560.703 (1) (am).

AB4-AA11, s. 1g Section 1g. 114.34 (4) of the statutes is created to read:

AB4-AA11,2,21 114.34 (4) The department may provide additional funding for airport improvements from the appropriation under s. 20.395 (9) (cs) if the department of administration receives the notice under s. 560.703 (1) (am).".

AB4-AA11,2,22 3. Page 1, line 3: delete " Section 1" and substitute "Section 1L".

AB4-AA11,2,23 4. Page 1, line 4: delete "par." and substitute "par. pars. (am) and".

AB4-AA11,2,24 5. Page 2, line 4: after that line insert:

AB4-AA11,3,1 " Section 1m. 560.703 (1) (am) of the statutes is created to read:

AB4-AA11,3,6 560.703 (1) (am) If the department does not allocate the additional $25,000,000 in tax benefits specified in par. (a) before July 1, 2012, the department may not allocate the additional $25,000,000 in tax benefits specified in par. (a) and the department shall notify the department of administration on July 1, 2012, that such tax benefits shall not be allocated.".

AB4-AA11,3,7 6. Page 2, line 7: after that line insert:

AB4-AA11,3,11 "(2) Transfer to transportation fund. If the department of administration receives the notice under section 560.703 (1) (am) of the statutes, as created by this act, the secretary of administration shall transfer $25,000,000 in fiscal year 2012-13 from the general fund to the transportation fund.".
