SENATE AMENDMENT 1, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2011 SENATE BILL 326

SB326-SSA1-SA1,1,1 At the locations indicated, amend the substitute amendment as follows:

SB326-SSA1-SA1,1,2 1. Page 6, line 18: delete lines 18 and 19 and substitute:

SB326-SSA1-SA1,1,3 " Section 9m. 30.12 (1k) (b) (intro.) of the statutes is amended to read:".

SB326-SSA1-SA1,1,4 2. Page 6, line 20: before "In" insert "(intro.)".

SB326-SSA1-SA1,1,6 3. Page 6, line 23: delete lines 23 and 24 and substitute "from the permit requirements under this section if all unless any of the following apply applies:".

SB326-SSA1-SA1,1,7 4. Page 6, line 25: after that line insert:

SB326-SSA1-SA1,1,8 " Section 10m. 30.12 (1k) (b) 1m. of the statutes is created to read:

SB326-SSA1-SA1,1,11 30.12 (1k) (b) 1m. The department notified the riparian owner before the effective date of this subdivision ..... [LRB inserts date], that the pier or wharf is detrimental to the public interest.".

SB326-SSA1-SA1,2,1 5. Page 7, line 1: delete that line and substitute:

SB326-SSA1-SA1,2,2 " Section 11m. 30.12 (1k) (b) 2. of the statutes is amended to read:

SB326-SSA1-SA1,2,4 30.12 (1k) (b) 2. The pier or wharf does not interfere interferes with the riparian rights of other riparian owners.".
