AB246,1,4 An Act to amend 20.866 (1) (u); and to create 13.48 (39i), 20.866 (2) (zbL) and 20.867 (3) (bL) of the statutes; relating to: expansion of accredited health care teaching institution facilities, granting bonding authority, and making an appropriation.

This bill authorizes the Building Commission to authorize up to $125,000,000 in general fund supported borrowing to make construction grants to accredited health care teaching institutions located in this state for the purpose of expanding their facilities. The amount of authorized borrowing under this program shall be staggered over a five-year period. Before making a grant to an accredited health care teaching institution, the Building Commission must determine that the institution has secured additional funding from nonstate sources in an amount at least equal to the grant and that the project will alleviate the shortage of trained health care professionals available to provide care to state residents.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB246,1 Section 1. 13.48 (39i) of the statutes is created to read:

AB246,2,2 13.48 (39i) Accredited health care teaching institutions. (a) In this subsection:

AB246,2,5 1. "Accredited health care teaching institution" means a nonstate health care institution that offers a program of instruction for health care professionals and that is accredited by a nationally recognized accrediting agency.

AB246,2,8 2. "Health care professional" means a person who, upon successful completion of a program of instruction at an accredited health care teaching institution, is eligible to be licensed, certified, or registered under ch. 441, 448, or 455.

AB246,2,14 (b) The legislature finds and determines that expanding access to accredited health care teaching institutions would greatly benefit state residents by addressing the increasing shortage of trained health care professionals available to provide care to state residents. It is therefore in the public interest, and it is the public policy of this state, to assist accredited health care teaching institutions with the expansion of their facilities.

AB246,2,23 (c) 1. Beginning on July 1, 2014, the building commission may authorize up to $125,000,000 in general fund supported borrowing to aid in the expansion of facilities of accredited health care teaching institutions located in this state. The state funding commitment shall be in the form of grants to the accredited health care teaching institutions. Before approving any state funding commitment to an accredited health care teaching institution, the building commission shall determine that the accredited health care teaching institution has secured additional funding from nonstate sources for the project in an amount at least equal to the amount of the grant.

AB246,3,3 2. If the building commission authorizes a grant to an accredited health care teaching institution under subd. 1. and if, for any reason, the facility that is expanded with funds from the grant is not used as an accredited health care teaching institution, the state shall retain an ownership interest in the facility equal to the amount of the state's grant.

AB246,3,8 (d) The building commission may not make a grant to an accredited health care teaching institution under this subsection unless the project will alleviate the shortage of trained health care professionals available to provide care to state residents. The department of health services shall assist each accredited health care teaching institution that applies for a grant in assessing its expansion needs.

(2) (zp) and ss. 20.115 (2) (d) and (7) (b) and (s), 20.190 (1) (c), (d), (i), and (j), 20.225 (1) (c) and (i), 20.245 (1) (e) and (j), 20.250 (1) (c) and (e), 20.255 (1) (d), 20.285 (1) (d), (je), and (gj), 20.320 (1) (c) and (t) and (2) (c), 20.370 (7) (aa), (ac), (ag), (aq), (ar), (at), (au), (bq), (br), (cb), (cc), (cd), (cg), (cq), (cr), (cs), (ct), (ea), (eq), and (er), 20.395 (6) (af), (aq), (ar), and (au), 20.410 (1) (e), (ec), and (ko) and (3) (e), 20.435 (2) (ee), 20.465 (1) (d), 20.485 (1) (f) and (go), (3) (t) and (4) (qm), 20.505 (4) (es), (et), (ha), and (hb) and (5) (c), (g), and (kc), 20.855 (8) (a), and 20.867 (1) (a) and (b) and (3) (a), (b), (bb), (bc), (bd), (be), (bf), (bg), (bh), (bi), (bj), (bk), (bL), (bm), (bn), (bp), (bq), (br), (bu), (bv), (g), (h), (i), (kd), and (q) for the payment of principal, interest, premium due, if any, and payment due, if any, under an agreement or ancillary arrangement entered into under s. 18.06 (8) (a) relating to any public debt contracted under subchs. I and IV of ch. 18.

AB246,3 Section 3. 20.866 (2) (zbL) of the statutes is created to read:

AB246,4,4 20.866 (2) (zbL) Accredited health care teaching institutions. From the capital improvement fund, a sum sufficient for the building commission to provide grants to accredited health care teaching institutions for the expansion of facilities as described in s. 13.48 (39i). The state may contract public debt in an amount not to exceed $125,000,000 for this purpose. The total amount of debt authorized under this paragraph may not exceed the following amounts on the following dates:

AB246,4,5 1. Prior to July 1, 2015, $25,000,000.

AB246,4,6 2. July 1, 2015, to June 30, 2016, $50,000,000.

AB246,4,7 3. July 1, 2016, to June 30, 2017, $75,000,000.

AB246,4,8 4. July 1, 2017, to June 30, 2018, $100,000,000.

AB246,4,9 5. July 1, 2018, or thereafter, $125,000,000.

AB246,4 Section 4. 20.867 (3) (bL) of the statutes is created to read:

AB246,4,18 20.867 (3) (bL) Principal repayment, interest and rebates; accredited health care teaching institutions. A sum sufficient to reimburse s. 20.866 (1) (u) for the payment of principal and interest costs incurred in financing the expansion of facilities for accredited health care teaching institutions, as described in s. 13.48 (39i), to make the payments determined by the building commission under s. 13.488 (1) (m) that are attributable to the proceeds of obligations incurred in financing the project, and to make payments under an agreement or ancillary arrangement entered into under s. 18.06 (8) (a).
