Foster care remissions and grants. Biennially, the amounts in
7the schedule to reimburse the Board of Regents of the University of Wisconsin
8System, technical college district boards, and private institutions under s. 39.51 for
9fee remissions and grants.”.

(2m) Private institutions. (a) In this subsection:

1. “Eligible individual” has the meaning given in s. 36.27 (3g) (a) 1.

2. “Federal assistance” has the meaning given in s. 36.27 (3g) (a) 2.

13. “Private institution” means a private and nonprofit postsecondary
2institution that is a member of the Wisconsin Association of Independent Colleges
3and Universities.

(b) A private institution that provides grants to eligible individuals for a
5semester or session may obtain reimbursement for the grants under par. (c) if all of
6the following are satisfied:

1. The individuals complete the federal Free Application for Federal Student
8Aid, as described in
20 USC 1090 (a), for that semester or session.

2. The individuals are enrolled in associate or bachelor's degree programs for
10that semester or session.

3. The amount of a grant to each individual is equal to the lesser of the
12following:

a. The amount of tuition the private institution charges the individual for that
14semester or session less the amount of any federal assistance awarded for the
15individual for that semester or session.

b. The amount of in-state tuition charged by the University of
17Wisconsin-Madison during that semester or session for a program that is
18comparable to the associate or bachelor's degree program in which the individual is
19enrolled.

4. The grants are not made to an individual after the private institution awards
21him or her a bachelor's degree or he or she attains the age of 25, whichever occurs
22first.

5. The grants are made to an individual for no more than a total of 12 semesters.
24For purposes of this subdivision, a session is counted as a semester.

16. The institution makes an additional grant to each individual from its own
2institutional funds, gifts, or grants that matches the amount under subd. 3.

(c) At the end of each semester, a private institution may certify to the board
4the number of students enrolled in the private institution to whom the private
5institution has made grants in compliance with par. (b) and the total amount of the
6grants after deducting the total amount of additional grants made under par. (b) 6.
7Subject to sub. (3), if the board approves the information certified under this
8paragraph, the board, from the appropriation account under s. 20.235 (1) (fx), shall
9reimburse the private institution for the full amount of the grants.”.

(3) Prorated reimbursement. In June of each fiscal year, the board shall
12determine the total amount of fees remitted by the Board of Regents that are eligible
13for reimbursement under sub. (1), the total amount of fees remitted by the district
14boards that are eligible for reimbursement under sub. (2), and the total amount of
15grants by private institutions that are eligible for reimbursement under sub. (2m).
16If the moneys appropriated under s. 20.235 (1) (fx) are not sufficient to reimburse the
17Board of Regents for the full amount of those fees, each district board for the full
18amount of those fees, and each private institution for the full amount of those grants,
19the board shall prorate the reimbursement paid under subs. (1), (2), and (2m) in the
20proportion that the moneys available bears to the total amount eligible for
21reimbursement under subs. (1), (2), and (2m).”.
