49.45 (60) Benefits for jail inmates.
(a) The department shall suspend, 7
instead of revoke, eligibility for the Medical Assistance program under this 8
subchapter while an individual who is a recipient of Medical Assistance benefits is 9
an inmate of a county jail such that the individual is eligible for Medical Assistance 10
benefits immediately upon release from jail. If implementation of this subsection 11
requires approval from the federal department of health and human services, the 12
department shall seek approval from the federal department of health and human
services to implement this subsection and shall implement this subsection to the 2
(b) A county or entity that administers the income maintenance program under 4
s. 49.78 shall provide to each inmate of a county jail information about eligibility and 5
benefits of the Medical Assistance program under this section. The county or the 6
entity that administers the income maintenance program shall enroll eligible 7
individuals who are inmates in the county jail in Medical Assistance and are being 8
released so that they may receive benefits immediately upon their release from jail.
9(61) Materials describing benefits.
The department shall create materials 10
describing with specificity the benefits, including mental health and addiction 11
service benefits, available under the Medical Assistance program under this 12
subchapter by each type of program and how to obtain those benefits. The 13
department shall make the materials under this subsection available to any 14
recipient of Medical Assistance under this subchapter.”.
