Notice of Hearing
The Department of Natural Resources announces that it will hold an online public hearing on a permanent rule, Board Order WT-02-19, to revise ch. NR 350, Wis. Adm. Code, relating to requirements for wetland mitigation. In accordance with s. 227.17, Wis. Stats., the DNR is seeking public comment and feedback on the rule at the time and virtual location shown below. Hearing Information

Rule Information:
The proposed ch. NR 350, Wis. Adm. Code, makes updates to wetland mitigation procedures for permittees, mitigation bank sponsors, and the in-lieu fee program. Outdated language is updated to match current statute, guidance and practice. Mitigation requirements for wetland permittees and exempt project proponents is updated to reflect changes in state statute and federal regulations. Procedures for establishing and operating a wetland mitigation bank are updated to follow federal regulations and practice. The DNR’s in-lieu fee program was established after the current NR 350, therefore a chapter on in-lieu fee processes and administration has been added.

Appearances at the Hearing and Submittal of Written Comments
The public has the opportunity to testify at the hearing. Registration will take place at the hearing by completing a Hearing Appearance form, which is available here. Pre-registration is strongly encouraged if you plan to provide spoken comments during the hearing. To pre-register, please download and complete the fillable Hearing Appearance form and send it to Amanda.Minks@Wisconsin.gov. Comments on the proposed rule must be received on or before April 23, 2021. Written comments may be submitted by U.S. mail, E-mail, or through the internet and will have the same weight and effect as oral statements presented at the public hearing.
