PETITION AND ORDER TO REPEAL UNAUTHORIZED RULES

PETITION

Pursuant to s. 227.26(4)(b)1, Stats., the Department of Military Affairs’ (DMA) Emergency Management Division (WEM) respectfully petitions the Joint Committee for Review of Administrative Rules to repeal rules that WEM has determined to be unauthorized.

PROPOSED ORDER

WEM proposes an order to repeal ch. WEM 6, relating to the establishment of certain standards for response and reimbursement procedures, including eligibility for reimbursement, for regional and local hazardous substance emergency response teams.

Explanation of agency authority: The proposed rule, which repeals ch. WEM 6, is authorized by s. 227.26(4), Stats.

Brief summary of proposed rule:

Chapter WEM 6 was promulgated under the authority of s. 323.70(7), Stats. That subsection was repealed by 2021 WI Act 104. The proposed rule repeals ch. WEM 6.

TEXT OF RULE

Section 1. Chapter WEM 6 is repealed.

Section 2. EFFECTIVE DATE. The rules adopted in this order shall take effect on the first day of the month following publication in the Wisconsin Administrative Register, pursuant to s. 227.22 (2), Stats.
