NOTICE OF PUBLIC HEARING AND COMMENT PERIOD
The Department of Agriculture, Trade and Consumer Protection (Department) announces that it will hold a public hearing on Emergency Rule EmR2208 and Emergency Rule EmR2210 relating to creating a commercial nitrogen optimization pilot program and providing crop insurance rebates for cover crops, at the time and place shown below.
EmR2208 implements the commercial nitrogen optimization pilot project program created under s. 92.14 (16) Stats., by 2021 Wisconsin Act 223. The Department is authorized to make grants for nitrogen optimization pilot projects conducted in collaboration with a University of Wisconsin System institution.
EmR2210 implements the crop insurance premium rebates for planting cover crop program created under s. 92.14 (17) Stats., by 2021 Wisconsin Act 223. The Department is authorized to provide rebates in the amount of $5 for each acre of a cover crop planted for crop insurance premiums paid on those acres.

Initial Regulatory Flexibility Analysis
EmR2208 will have no adverse effect on small business. Because participation in the program is voluntary, there will be no negative economic impact produced by the rule. EmR2208 will enable the Department to provide grants to agricultural producers to voluntarily participate in commercial nitrogen optimization pilot projects. Grant funds should positively impact businesses that provide goods and services used in activities under this rule.
EmR2210 will have no adverse effect on small business. Because participation in the program is voluntary, there will be no negative economic impact produced by the rule. The proposed rule will enable the Department to provide rebates to producers who plant cover crops. Grant funds should positively impact businesses that utilize cover crops.
