Notice of Preliminary Hearing on Statement of Scope
The Department of Natural Resources announces that it will hold a preliminary public hearing on Statement of Scope SS 088-22 (Board Order WA-11-22), revisions to chs. NR 500 to 524 related to landfills, solid waste management fees, financial responsibility and reporting requirements. In accordance with s. 227.136, Wis. Stats., the DNR is seeking public comment and feedback on Statement of Scope SS 088-22 at the time and virtual location shown below.

Rule Information
Wisconsin’s solid waste management rules have not been substantially revised since the 1990s with only limited updates since. Industry standards have evolved over the last 30 years and landfill owners and operators have requested exemptions to solid waste rules where the rules do not provide for alternative approaches. In addition, plan review and licensing fees established in 2006 do not account for inflationary changes and may no longer be consistent with the statutory requirement to establish review fees at a level anticipated to recover the solid waste program staff review costs.
The proposed rule will amend portions of chs. NR 500 to 524, Wis. Adm. Code, to incorporate changes to solid waste landfill requirements and to solid waste management fees, financial responsibility, and reporting requirements. The proposed rule would improve the management of landfills in Wisconsin, create efficiencies and reflect experience and industry changes over the last 30 years while continuing to protect public health and the environment. The proposed rule would include updates to fees consistent with statutory requirements.

Comments on the proposed scope statement must be received on or before December 22, 2022. Written comments may be submitted by U.S. mail, E-mail, or through the internet and will have the same weight and effect as oral statements presented at the public hearing.
