Notice of Public Hearing and Comment Period on Statement of Scope
The Wisconsin Department of Transportation announces that it will hold a public hearing on statement of scope SS 025-23, indicating WisDOT’s intent to engage in rulemaking to revise ch. Trans 309, Wis. Admin. Code, relating to ambulance inspection standards. The statement of scope for this proposed rule was published in Wis. Admin. Registister No. 809A1 on May 1, 2023. In accordance with s. 227.136, Stats., WisDOT will hold a public hearing and receive public comments regarding the proposed rulemaking as described in SS 025-23, as follows, at the time and place shown below.

Rule Information
WisDOT intends to engage in emergency and permanent rulemaking to amend ch. Trans 309. Chapter Trans 309 subch. III describes requirements for ambulance equipment. Section 341.085, Stats., requires WisDOT to inspect all ambulances for the standards listed in ch. Trans 309, subch. III. Section Trans 309.25 repeals subch. III on July 15, 2023, or upon promulgation by the department of health services (DHS) of administrative rules establishing standards and inspection, whichever comes sooner. Currently, DHS does not have authority to promulgate rules establishing standards and inspections. WisDOT needs to commence emergency rulemaking to extend the repeal date in order to preserve ambulance safety and to protect the consumer, general public, and those travelling throughout Wisconsin.

Comments on the proposed scope statement must be received on or before 4:00 p.m. on Wednesday, May 31, 2023. Written comments may be submitted by U.S. mail or e-mail and will have the same weight and effect as oral statements presented at the public hearing.
