NARRATIVE
1.   Finding/nature of the emergency (Emergency Rule only).

2.   A description of the objective of the proposed rule.
PI 34.034 relates to the requirements of a Tier I Professional Teaching Permit in one of the identified critical teacher shortage areas including American Sign Language, music, art, foreign language, computer science, mathematics, and science.
The proposed rule seeks to clarify ch. PI 34 of the Wisconsin Administrative Code with respect to the requirements laid out in Wis. Stats. S. 118.192 for obtaining a Tier I, professional teaching permit under s. PI 34.034 with respect to professional work experience, formal instruction, standardized exam requirements, renewal criteria and school district requests for the license. 
3.   A description of the existing policies and new policies included in the proposed rule and an analysis of policy alternatives.
Chapter PI 34 of the Wisconsin Administrative Code contains the rules governing educator licensure, including the requirements for obtaining a Tier I, professional teaching permit to teach kindergarten through grade 12 in one of the following subject areas: American Sign Language, art, computer science, foreign language, mathematics, music, science, and technology education. In order to obtain a professional teaching permit under s. PI 34.034, an applicant must, in part, meet the professional work experience requirements under s. 118.192 (2), Stats., in a subject area corresponding to the applicant's degree (see s. PI 34.034 (2) (b)); satisfactorily completed an alternate teacher training program consisting of approximately 100 hours of formal instruction in the application of modern curricula in the subject area sought by the applicant (see s. PI 34.034 (2) (c)); and received a passing score on a standardized examination under s. PI 34.021 (1) (c) 2 as determined by the state superintendent (see s. PI 34.034 (2) (d)). The proposed rule seeks to clarify the work experience requirements under s. PI 34.034 (2) (b), what makes up 100 hours of formal instruction under s. PI 34.034 (2) (c), the standardized exam requirements under s. PI 34.034 (2) (d), clarifies renewal criteria under s. PI 34.034 (4), and to specify that the license application requirements for school districts requesting the license.
Without a rule, the department would be required to implement ch. PI 34 as the rules currently exist, which may result in confusion for license applicants.
4.   The statutory authority for the proposed rule.
Under. 118.19 (1), Stats., any person seeking to teach in a public school, including a charter school, or in a school or institution operated by a county or the state shall first procure a license or permit from the department. Under Wis. Stat. s. 115.28 (7) (a) the superintendent of public instruction shall make rules establishing standards of attainment and procedures for the examination and licensing of teachers within the limits prescribed in ss. 118.19 (2) and (3), 118.191, 118.192, 118.193, 118.194, and 118.195. Further, s. 118.192 generally describes the requirements associated with a professional teaching permit. As such, a rule is required to establish specific criteria for the issuance of professional teacher permits under s. 118.192, Stats.

The amount of time needed for rule development by department staff and the amount of other resources necessary are indeterminate.

This rule change would impact individuals seeking a professional teacher permit under Wis. Stat. § 118.192.
7.   A summary and preliminary comparison of any existing or proposed federal regulation that addresses or is intended to address the activities to be regulated by the proposed rule.
