NARRATIVE
1.   Finding/nature of the emergency (Emergency Rule only).

2.   A description of the objective of the proposed rule.
The proposed rule seeks to clarify ch. PI 34 of the Wisconsin Administrative Code with respect to the rules governing assessment teams and the recommendation for licensure as they relate to Tier IV, master educator licenses under s. PI 34.042.
3.   A description of the existing policies and new policies included in the proposed rule and an analysis of policy alternatives.
Chapter PI 34 of the Wisconsin Administrative Code contains the rules governing educator licensure, including the requirements for obtaining a Tier IV, master educator license. Under the rule, the superintendent may issue a tier IV, master educator license to an applicant who, in part, receives a recommendation from an assessment team for tier IV licensure. The assessment team shall meet all of the following requirements: 1) be composed of 3 educators who have the same or similar job responsibilities and may also include a school board member; 2) be nominated by professional organizations and be approved by the state superintendent; and 3) successfully completed training provided by the department. Further, the assessment team shall base its recommendation for tier IV licensure on the following: 1) a formal assessment process of the applicant demonstrates that the applicant has mastered of the applicable standards under subch. II of ch. PI 34. The assessment process shall be comparable to the national board for professional teaching standards process and be approved by the state superintendent; and 2) the applicant demonstrates exemplary professional performance through video or on-site observation by the assessment team. The proposed rule seeks to simplify the assessment process and review to facilitate a faster process leading to a recommendation for licensure. Without a rule change, the department would be required to implement ch. PI 34 as the rules currently exist.
4.   The statutory authority for the proposed rule.
Under. 118.19 (1), Stats., any person seeking to teach in a public school, including a charter school, or in a school or institution operated by a county or the state shall first procure a license or permit from the department. Wis. Stat. s. 115.28 (7) (a) requires, in relevant part, that the superintendent of public instruction shall make rules establishing standards of attainment and procedures for the examination and licensing of teachers within the limits prescribed in ss. 118.19 (2) and (3), 118.191, 118.1915, 118.192, 118.193, 118.194, 118.195, and 118.197.
5.   An estimate of the amount of time agency employees will spend developing the proposed rule and of other resources needed to develop the rule.
The amount of time needed for rule development by department staff and the amount of other resources necessary are indeterminate.

This rule change will affect internal DPI staff, education groups representing teachers, and Professional Standards Council for Teachers.
7.   A summary and preliminary comparison of any existing or proposed federal regulation that addresses or is intended to address the activities to be regulated by the proposed rule.
