NARRATIVE
1.   Finding/nature of the emergency (Emergency Rule only).

2.   A description of the objective of the proposed rule.
The proposed rule change is a technical correction of ch. PI 34 of the Wisconsin Administrative Code to clarify that for educator preparation programs leading to a license, practicum experiences must occur in school settings.
3.   A description of the existing policies and new policies included in the proposed rule and an analysis of policy alternatives.
Chapter PI 34 of the Wisconsin Administrative Code contains the rules governing educator licenses, including the rules around educator preparation. Section PI 34.023 (3) requires that, for educator preparation programs leading to a pupil services or administrative license, the clinical program shall include supervised practicums in the area of licensure that: are developmental in scope and sequence; results in the student being able to demonstrate knowledge and understanding of the standards under subch. II of ch. PI 34; and evaluates each student’s performance. Since the rules were written, the department has identified a needed technical correction which would clarify that for educator preparation programs leading to a license, the practicum experience must occur in school settings. Similar language will also be required regarding school settings for pre-student teaching in s. PI 34.023 (1) and student teaching in s. PI 34.023 (2) under the proposed rule. The effect of the change will create greater clarity in the rule. Absent a rule change, the department will be required to implement ch. PI 34 as it currently exists, which may create confusion for educator preparation programs and students enrolled in an approved program.
4.   The statutory authority for the proposed rule.
Under. 118.19 (1), Wis. Stats., any person seeking to teach in a public school, including a charter school, or in a school or institution operated by a county or the state shall first procure a license or permit from the department. Under Wis. Stat. s. 115.28 (7) (a), the superintendent of public instruction shall make rules establishing standards of attainment and procedures for the examination and licensing of teachers within the limits prescribed in ss. 118.19 (2) and (3), 118.191, 118.192, 118.193, 118.194, and 118.195.

The amount of time needed for rule development by department staff and the amount of other resources necessary are indeterminate.

These rule changes would impact internal DPI staff, education preparation programs, and students enrolled in teacher preparation programs.
7.   A summary and preliminary comparison of any existing or proposed federal regulation that addresses or is intended to address the activities to be regulated by the proposed rule.
