SENATE AMENDMENT 1, To 1995 ASSEMBLY BILL 393

AB393-SA1,1,1 At the locations indicated, amend the bill as follows:

AB393-SA1,1,4 1. Page 3, line 1: in the material inserted by assembly amendment 2, on page 1, line 13, of assembly amendment 2, before the material inserted by assembly amendment 1 to assembly amendment 2, insert:

AB393-SA1,1,9 "(f) If a pilot project involves the provision of heating, cooling or power service by a public utility, as defined in section 196.01 (5) of the statutes, or a cooperative organized under chapter 185 of the statutes to a state-owned heating and cooling plant, the secretary shall only procure the service from the public utility or cooperative in whose service territory the plant is located.

AB393-SA1,1,14 (g) No agency may sell any heating, cooling or power service under a pilot project to any person to whom the agency was not selling the service on January 1, 1996, nor in a total quantity that, together with other sales, exceeds the quantity, if any, that the agency was contractually obligated to sell to that person on January 1, 1996.

AB393-SA1,2,2 2. Page 3, line 6: delete "(f)", as affected by assembly amendment 2, and substitute "(i)".

AB393-SA1,2,4 3. Page 3, line 7: delete "August 1, 1996" and substitute: "the first day of the 8th month beginning after publication of this act".

AB393-SA1,2,6 4. Page 3, line 9: after that line, delete the material inserted by assembly amendment 1, and substitute:

AB393-SA1,2,8 "(j) The committee terminates on the 2nd day of the 8th month beginning after publication of this act.".
