AB591-ASA1,55,517 (b) Time-limited participation. An individual may participate in a community
18service job for a maximum of 6 months, with an opportunity for a 3-month extension
19under circumstances approved by the department. An individual may participate
20in more than one community service job, but may not exceed a total of 24 months of
21participation under this subsection. The months need not be consecutive. The
22department or, with the approval of the department, the Wisconsin works agency
23may grant an extension to the 24-month limit on a case-by-case basis if the
24Wisconsin works agency determines that the individual has made all appropriate
25efforts to find unsubsidized employment and has been unable to find unsubsidized

1employment because local labor market conditions preclude a reasonable
2employment opportunity in unsubsidized employment for that participant, as
3determined by a Wisconsin works agency and approved by the department, and if the
4Wisconsin works agency determines, and the department agrees, that no trial job
5opportunities are available in the specified local labor market.
AB591-ASA1,55,96 (c) Worker's compensation. A participant under this subsection is an employe
7of the Wisconsin works agency for purposes of worker's compensation coverage,
8except to the extent that the person for whom the participant is performing work
9agrees to provide worker's compensation coverage.
AB591-ASA1,55,13 10(5) Transitional placement. (a) Additional eligibility criteria. An individual
11is eligible to participate in a transitional placement under this subsection if, in
12addition to meeting the eligibility requirements under s. 49.145, any of the following
13conditions is met with respect to the individual:
AB591-ASA1,55,1714 1. The Wisconsin works agency determines, on the basis of an independent
15assessment by the division of vocational rehabilitation or similar agency or business,
16that the individual has been incapacitated, or will be incapacitated, for a period of
17at least 60 days.
AB591-ASA1,55,2018 2. The Wisconsin works agency determines that the individual is needed in the
19home because of the illness or incapacity of another member of the Wisconsin works
20group.
AB591-ASA1,55,2221 3. The Wisconsin works agency determines that the individual is incapable of
22performing a trial job or community service job.
AB591-ASA1,56,223 (b) Administration. 1. The Wisconsin works agency shall assign a participant
24under this subsection to work activities such as a community rehabilitation program,
25as defined by the department, a job similar to a community service job or a volunteer

1activity. A Wisconsin works agency may require a participant under this subsection
2to participate in any of the following:
AB591-ASA1,56,43 a. An alcohol and other drug abuse evaluation, assessment and treatment
4program.
AB591-ASA1,56,55 b. A training or education program, as defined by the department by rule.
AB591-ASA1,56,66 c. Mental health activities, as defined by the department by rule.
AB591-ASA1,56,77 d. Counseling or physical rehabilitation activities.
AB591-ASA1,56,98 e. Other activities that the Wisconsin works agency determines are consistent
9with the capabilities of the individual.
AB591-ASA1,56,1310 2. An individual may participate in a transitional placement for a maximum
11of 24 months. The months need not be consecutive. This period may be extended on
12a case-by-case basis by the department or by the Wisconsin works agency with the
13approval of the department.
AB591-ASA1,56,1714 (c) Worker's compensation. A participant under this subsection is an employe
15of the Wisconsin works agency for purposes of worker's compensation coverage,
16except to the extent that the person for whom the participant is performing work
17agrees to provide worker's compensation coverage.
AB591-ASA1,56,20 18(6) Job access loan. (a) Additional eligibility criteria. An individual is eligible
19to receive a job access loan if, in addition to meeting the eligibility requirements
20under s. 49.145, all of the following conditions are met with respect to the individual:
AB591-ASA1,56,2321 1. The individual needs the loan to address an immediate and discrete financial
22crisis. The crisis may not be the result of the individual's failure to accept a bona fide
23offer of employment or the individual's termination of a job without good cause.
AB591-ASA1,56,2424 2. The individual needs the loan to obtain or continue employment.
AB591-ASA1,57,2
13. The individual is not in default with respect to the repayment of any previous
2job access loan or repayment of any grant or wage overpayments under this section.
AB591-ASA1,57,33 4. The individual is not a migrant worker.
AB591-ASA1,57,54 (b) Terms. The department shall promulgate rules establishing the terms of
5any job access loan, including all of the following:
AB591-ASA1,57,66 1. The maximum and minimum loan amounts in any 12-month period.
AB591-ASA1,57,77 2. The method of loan disbursement.
AB591-ASA1,57,88 3. The terms and conditions of repayment.
AB591-ASA1,57,129 (c) Distribution and administration. From the appropriation under s. 20.445
10(3) (dz), the department shall distribute funds for job access loans to a Wisconsin
11works agency, which shall administer the loans in accordance with rules
12promulgated by the department.
AB591-ASA1,57,1513 (d) Minor custodial parents. An individual who would be eligible for a job access
14loan under par. (a), except that the individual has not attained the age of 18, is
15eligible under this paragraph if the individual meets the following requirements:
AB591-ASA1,57,1716 1. The individual is in an out-of-home placement or independent living
17arrangement supervised by an adult, as defined by the department.
AB591-ASA1,57,2018 2. The individual has graduated from high school or has met the standards
19established by the secretary of education for the granting of a declaration of
20equivalency of high school graduation under s. 115.29 (4).
AB591-ASA1,57,2221 3. The individual will be 18 years old within 2 months after applying for the
22job access loan.
AB591-ASA1, s. 87 23Section 87. 49.148 of the statutes is created to read:

149.148 Wisconsin works; benefits for participants in employment
2positions.
(1) Benefit levels. A participant in a Wisconsin works employment
3position shall receive the following benefits:
AB591-ASA1,58,74 (a) Trial jobs. For a participant in a trial job, the amount established in the
5contract between the Wisconsin works agency and the trial job employer, but not less
6than minimum wage for every hour actually worked in the trial job, not to exceed 40
7hours per week paid by the employer.
AB591-ASA1,58,148 (b) Community service jobs. 1. For a participant in a community service job,
9a monthly grant equal to 75% of the minimum wage computed for one month of
10full-time employment, paid by the Wisconsin works agency. For every hour that the
11participant misses work without good cause, the Wisconsin works agency shall
12reduce the grant amount by an amount equal to 75% of minimum wage computed for
13one hour. Good cause shall be determined by the financial and employment planner
14in accordance with rules promulgated by the department.
AB591-ASA1,58,1915 2. A participant who is a custodial parent of a child who is 12 weeks old or less
16may receive a monthly grant under this paragraph equal to 75% of minimum wage
17computed for a month of full-time employment. A Wisconsin works agency may not
18require a participant under this subdivision to participate in any employment
19activities.
AB591-ASA1,59,420 (c) Transitional placements. For a participant in a transitional placement, a
21grant equal to 70% of the minimum wage computed for one month of full-time
22employment, paid monthly by the Wisconsin works agency. For every hour that the
23participant fails to participate in any required activity without good cause, including
24any activity under s. 49.147 (5) (b) 1. a. to e., the Wisconsin works agency shall reduce
25the grant amount by an amount equal to 70% of minimum wage computed for one

1hour. No grant may be paid for a month in which the participant participates less
2than 25% of the required hours without good cause. Good cause shall be determined
3by the financial and employment planner in accordance with rules promulgated by
4the department.
AB591-ASA1,59,7 5(2) Benefit review. Notwithstanding sub. (1), the department may promulgate
6rules establishing benefit levels for participants in Wisconsin works employment
7positions that are different from those specified under sub. (1).
AB591-ASA1,59,11 8(3) Wisconsin works health plan. A participant in a Wisconsin works
9employment position shall participate in the Wisconsin works health plan under s.
1049.153. The participant shall pay a premium in an amount and in the manner
11established under s. 49.153 (4) (d).
AB591-ASA1, s. 88 12Section 88. 49.149 of the statutes is created to read:
AB591-ASA1,59,14 1349.149 Wisconsin works; education and training. A Wisconsin works
14agency shall do all of the following:
AB591-ASA1,59,17 15(1) Establish a referral relationship with other employment and training
16programs for participants to make use of varied education and training opportunities
17available through integrated job centers, as defined by the department by rule.
AB591-ASA1,59,19 18(2) Provide participants in a Wisconsin works employment position with
19soft-skills and life-skills training, as defined by the department by rule.
AB591-ASA1,59,21 20(3) Encourage employers to make training sites available on the business site
21for participants.
AB591-ASA1,59,24 22(4) Work with the department of commerce to coordinate the provision of
23training to participants in conjunction with employers eligible for the development
24zone program under subch. VI of ch. 560.
AB591-ASA1, s. 89 25Section 89. 49.151 of the statutes is created to read:

149.151 Wisconsin works; sanctions. A participant who refuses to
2participate 3 times in any Wisconsin works employment position component is
3ineligible to participate in that component. A participant whom the Wisconsin works
4agency has determined is ineligible under this section for a particular Wisconsin
5works employment position component may be eligible to participate in any other
6Wisconsin works employment position component in which the participant has not
7refused to participate 3 times. A participant refuses to participate in a Wisconsin
8works employment position component if the participant does any of the following:
AB591-ASA1,60,10 9(1) Expresses verbally or in writing to a Wisconsin works agency that he or she
10refuses to participate.
AB591-ASA1,60,14 11(2) Fails to appear for an interview with a prospective employer or, if the
12participant is in a Wisconsin works transitional placement, fails to appear for an
13assigned activity, including an activity under s. 49.147 (5) (b) 1. a. to e., without good
14cause, as determined by the Wisconsin works agency.
AB591-ASA1,60,16 15(3) Voluntarily leaves appropriate employment or training without good cause,
16as determined by the Wisconsin works agency.
AB591-ASA1,60,17 17(4) Loses employment as a result of being discharged for cause.
AB591-ASA1,60,20 18(5) Demonstrates through other behavior or action, as specified by the
19department by rule, that he or she refuses to participate in a Wisconsin works
20employment position.
AB591-ASA1, s. 90 21Section 90. 49.152 of the statutes is created to read:
AB591-ASA1,61,4 2249.152 Review of agency decisions. (1) Petition for review. Any
23individual whose application for Wisconsin works under s. 49.147 (1) to (5) is not
24acted upon by the Wisconsin works agency with reasonable promptness after the
25filing of the application, as defined by the department by rule, or is denied in whole

1or in part, whose benefit is modified or canceled, or who believes that the benefit was
2calculated incorrectly, may petition the Wisconsin works agency for a review of such
3action. Review is unavailable if the action by the Wisconsin works agency occurred
4more than 45 days prior to submission of the petition for review.
AB591-ASA1,61,10 5(2) Review. (a) Upon a timely petition under sub. (1), the Wisconsin works
6agency shall give the applicant or participant reasonable notice and opportunity for
7a review. The Wisconsin works agency shall render its decision as soon as possible
8after the review and shall send a certified copy of its decision to the applicant or
9participant. The Wisconsin works agency shall deny a petition for a review or shall
10refuse to grant relief if the petitioner does any of the following:
AB591-ASA1,61,1111 a. Withdraws the petition in writing.
AB591-ASA1,61,1412 b. Abandons the petition. Abandonment occurs if the petitioner fails to appear
13in person or by representative at a scheduled review without good cause, as defined
14by the department by rule.
AB591-ASA1,61,1615 (b) The department may review a decision of a Wisconsin works agency under
16par. (a).
AB591-ASA1, s. 91 17Section 91. 49.153 of the statutes is created to read:
AB591-ASA1,61,18 1849.153 Wisconsin works health plan. (1) Definitions. In this section:
AB591-ASA1,61,2219 (a) "Employer-subsidized health care coverage" means health care coverage
20offered by the employer for which the employer pays at least 50% of the cost of
21coverage for the employe, including dependent coverage, or a higher percentage as
22determined by the department by rule.
AB591-ASA1,61,2523 (b) "Unsubsidized employer-offered health care coverage" means health care
24coverage offered by the employer for which the employer pays less than 50% of the
25cost of coverage for the employe including dependent coverage.
AB591-ASA1,62,5
1(2) Administration. The department of health and family services shall
2provide health services and benefits under sub. (4) to individuals who have been
3determined by a Wisconsin works agency to be eligible under sub. (3) for such services
4and benefits. The Wisconsin works agency shall provide the department of health
5and family services with a list of eligible individuals.
AB591-ASA1,62,17 6(3) Eligibility. (a) General provisions. 1. A Wisconsin works agency shall
7determine eligibility for benefits and services under this section, in accordance with
8rules promulgated by the department of health and family services in consultation
9with the department of industry, labor and job development. An individual who
10applies for and receives benefits and services under this section is considered to have
11assigned to the state any rights to medical support or other payment of medical
12expenses from any other person, including rights to unpaid amounts accrued at the
13time of application for benefits and services under this section and any rights to
14support accruing during the time for which benefits and services under this section
15are provided. Eligibility for benefits and services under this section begins on the day
16on which the department of health and family services or the provider issues a health
17plan membership card.
AB591-ASA1,62,2118 2. Except as provided in subd. 3. and pars. (em) and (f), an individual who is
19eligible for the health care coverage under this section remains eligible under this
20section for 12 consecutive months or until the individual has access to unsubsidized
21employer-offered health care coverage, whichever is later.
AB591-ASA1,62,2422 3. A Wisconsin works agency shall periodically review an individual's
23eligibility. The individual remains eligible for benefits and services under this
24section until any of the following applies:
AB591-ASA1,63,3
1a. The assets of the individual or, if the individual is a member of a Wisconsin
2works group, the assets of the Wisconsin works group of which the individual is a
3member, exceed the asset limits for at least 2 months.
AB591-ASA1,63,64 b. The income of the individual, or, if the individual is a member of a Wisconsin
5works group, the income of the Wisconsin works group of which the individual is a
6member is expected to exceed the income limits for at least 2 consecutive months.
AB591-ASA1,63,97 (b) Wisconsin works groups. Except as provided in pars. (d) and (e), an
8individual who is a member of a Wisconsin works group is eligible for benefits and
9services under this section if all of the following conditions apply:
AB591-ASA1,63,1110 1. The individual meets the criteria under s. 49.145 (2) (c), (f), (g), (i), (L) and
11(m) and resides in this state.
AB591-ASA1,63,1212 2. The Wisconsin works group meets the asset limitation under s. 49.145 (3) (a).
AB591-ASA1,63,1713 3. The gross income of the Wisconsin works group is at or below 165% of the
14poverty line, or, for a Wisconsin works group that is already receiving health care
15coverage under this section, the gross income is at or below 200% of the poverty line.
16In calculating the gross income of the Wisconsin works group, the Wisconsin works
17agency shall include income described under s. 49.145 (3) (b) 1. to 3.
AB591-ASA1,63,2018 (c) Pregnant women. Except as provided in par. (e), a pregnant woman whose
19pregnancy has been medically verified and who has no dependent children is eligible
20for benefits and services under this section if she meets the following conditions:
AB591-ASA1,63,2221 1. The woman meets the criteria under s. 49.145 (2) (c), (g), (i), (L) and (m) and
22resides in this state.
AB591-ASA1,63,2323 2. The woman meets the asset limitation under s. 49.145 (3) (a).
AB591-ASA1,64,3
13. The gross income of the woman is at or below 165% of the poverty line. In
2calculating gross income under this subdivision, the Wisconsin works agency shall
3include income described under s. 49.145 (3) (b) 1. and 3.
AB591-ASA1,64,74 (d) Minor parents. An individual who is a custodial parent and who is under
5the age of 18, and any dependent children with respect to whom the individual is a
6custodial parent, are eligible for benefits and services under this section only if the
7individual meets any of the following conditions:
AB591-ASA1,64,128 1. The individual resides with his or her custodial parent and the gross income
9of the Wisconsin works group of which the individual is a member does not exceed
10165% of the poverty line. In calculating the gross income of the Wisconsin works
11group, the Wisconsin works agency shall include income described under s. 49.145
12(3) (b) 1. to 3.
AB591-ASA1,64,1613 2. The individual is in an independent living arrangement supervised by an
14adult and the gross income of the individual does not exceed 165% of the poverty line.
15In calculating the gross income of the individual, the Wisconsin works agency shall
16include income described under s. 49.145 (3) (b) 1. to 3.
AB591-ASA1,64,2117 (e) Access to employer-subsidized health care coverage. An individual is eligible
18for health care coverage under this section only if the individual has not had access
19to employer-subsidized health care coverage for the 18 months immediately
20preceding application for health care coverage under this section. This paragraph
21does not apply to any of the following:
AB591-ASA1,65,222 1. An individual who has lost access to employer-subsidized health care
23coverage within the 18 months immediately preceding application for health care
24coverage under this subsection because of the termination by the employer of the
25employment relationship for a reason other than misconduct on the part of the

1employe and who has not had access to employer-subsidized health care coverage
2since the termination.
AB591-ASA1,65,63 2. An individual who has lost access to employer-subsidized health care
4coverage within the 18 months immediately preceding application for health care
5coverage under this subsection because of the termination by the employe of the
6employment relationship for just cause.
AB591-ASA1,65,87 3. A dependent child who has lost eligibility for employer-subsidized health
8care coverage for any reason.
AB591-ASA1,65,99 4. A participant in a Wisconsin works employment position.
AB591-ASA1,65,1610 (em) Continuous coverage requirement. An individual who withdraws from
11health care coverage under this section while the individual is still eligible for health
12care coverage under this section is ineligible for health care coverage under this
13section for a period of 6 months following the withdrawal. Failure to pay in a timely
14manner, as defined by the department of industry, labor and job development by rule,
15the premium established under sub. (4) (d) constitutes withdrawal for purposes of
16this paragraph.
AB591-ASA1,65,1917 (f) Ineligibility. No individual is eligible for health care coverage under this
18section in a month in which that individual is eligible for employer-subsidized health
19care coverage.
AB591-ASA1,66,2 20(4) Wisconsin works health plan. (a) Health maintenance organization
21contract.
The department of health and family services shall contract with one or
22more health maintenance organizations or other health care providers to provide
23health care services under this subsection. Each contract for the provision of health
24care services entered into by the department of health and family services under this

1subsection shall be awarded on the basis of a competitive process in accordance with
2procedures established by the department of health and family services.
AB591-ASA1,66,53 (b) Health care services provided. 1. Except as provided in subd. 2., the
4Wisconsin works health plan shall cover the care and services specified under s.
549.46 (2).
AB591-ASA1,66,862. Except as otherwise required under a federal waiver received under 42 USC
71315
, the Wisconsin works health plan shall not cover the following goods and
8services:
AB591-ASA1,66,109 a. Home care, as defined in s. 632.895 (1) (b), in excess of the minimum required
10under s. 632.895 (2).
AB591-ASA1,66,1111 b. Skilled nursing care in excess of the minimum required under s. 632.895 (3).
AB591-ASA1,66,1212 c. Over-the-counter drugs.
